Municipality of Anchorage Austin Quinn-Davidson, Acting Mayor MUNICIPALITY OF ANCHORAGE PROCLAMATION OF ADDITIONAL EMERGENCY ORDER GATHERING CAPACITY LIMITATIONS AT BARS, RESTAURANTS, GYMS, AND MORE ISSUED BY THE ACTING MAYOR OF THE MUNICIPALITY OF ANCHORAGE PURSUANT TO ANCHORAGE MUNICIPAL CODE SECTION 3.80.06OH. Anchorage is experiencing its highest levels of community transmission of COVID-19 to date. To reduce the level of COVID-19 transmission in our community and to prevent its resurgence, continued restrictions are necessary, even as we try to maintain a mostly-open economy. The pandemic presents a public health emergency that threatens to overwhelm our health system, endangering the lives and wellbeing of the people of Anchorage. The following ?ndings about motivate these mandates and recommendations. First, COVID-IQ is a respiratory virus. It moves from person to person through tiny respiratory droplets and aerosols that are released when a person with coughs, sneezes, talks, or sings. People become infected by inhaling these droplets or aerosols. Second, this virus spreads easily to people who are in close contact to a person with COVID- 19, especially indoors, and especially when the contact lasts more than ?fteen minutes. Third, even people with no can be highly infectious to the people around them. Fourth, keeping a safe distance?at least 6 feet?away from other people outside your household is the best way to reduce transmission and prevent infection. Fifth, face coverings help protect the wearer and other people from COVID-19. Because of the above, Anchorage now needs the following restrictions on public interactions to preserve health and save lives in our community. I HEREBY ORDER THE FOLLOWING EMERGENCY REGULATIONS, UPDATED AS OF 8:00 A.M. ON NOVEMBER 9, 2020. THE FOLLOWING EMERGENCY REGULATIONS HAVE THE POWER OF LAW, SHALL REMAIN IN EFFECT UNTIL REVOKED, AND SHALL SUPERSEDE ALL CONFLICTING LAWS DURING THE EXISTENCE OF THIS EMERGENCY. THIS ORDER REPLACES EMERGENCY ORDER 15, WHICH HAS EXPIRED, AND SUPERSEDES, IN PART, EMERGENCY ORDER 10. 1. Individuals. Everyone in the Municipality of Anchorage (the ?Municipality?) shall limit outings and physical contact with those outside of their household and a small chosen closed group of other individuals. On the occasions when individuals leave home, they E044 v3 11/6/2020 pg. 1 Municipality of Anchorage Austin Quinn-Davidson, Acting Mayor shall maintain physical distancing of at least six feet from any person outside their household/small group whenever possible. Individuals are required to wear a face covering or mask in public, as detailed in Emergency Order 13. Individuals are also strongly encouraged to practice recommended hygiene, including regular hand washing. At-Risk Individuals. People at high risk of serious illness with COVID-19 should take even greater precautions. Those particularly at-risk of complications from COVID-19 should reduce exposure by staying at home, not physically going to work, minimizing in?person interactions with others outside their household, and not doing their own shopping if at all possible. Household members of those who are at elevated risk should implement these more stringent guidelines as well, to the extent possible. Requirements for Individuals Likely to be Contagious with Individuals likely to be contagious with COVID-19 are required to minimize contact with others as follows: a. People who are exhibiting of (including the following when not attributable to other known causes: coughing, shortness of breath, fever, fatigue, chills, muscle pain, sore throat, headache, congestion or runny nose, diarrhea, or new loss of taste or smell) shall stay home except to seek medical care and testing. b. As detailed in Emergency Order 1 1, individuals who have traveled from outside Alaska are required upon arrival/return to limit contact with others pending negative testing results or to self-quarantine. 0. Household members of those who are possibly contagious should exercise physical distancing and enhanced hygiene within the home, and refrain from leaving the home to the extent possible. d. Individuals who have been contacted by health authorities as a known contact of a positive case shall quarantine for the length of time directed by a public health professional. e. Individuals who have tested positive for COVID-19 shall remain in isolation until cleared by a public health professional. 130-14 v3 11/6/2020 pg. 1 .- Municipality of Anchorage Austin Quinn-Davidson, Acting Mayor Gathering Limitations. All individuals must wear masks or face coverings and maintain six feet of physical distancing between household groups at all gatherings. Gatherings are de?ned as meetings or other events that bring together people ?'om multiple households at the same time for a shared or group experience in a single room, space, or place such as auditorium, stadium, arena, large conference room, meeting hall, or other indoor or outdoor space. All indoor events and gatherings involving consumption of food or drink are limited to 10 people in a single enclosed indoor space; indoor gatherings without food or drink are limited to 15 people. All outdoor gatherings involving consumption of food or drink must be limited to 20 people; outdoor gatherings without food or drink are limited to 30 people. The following exceptions apply to the gathering limits: a. The gathering limitation does not limit shopping at farmer?s markets or outdoor food-truck events where six-feet of physical distancing between customers is maintained, provided that on-site dining is discouraged, and no tables and chairs are provided for dining. b. The gathering limitation does not limit drive-in events where groups remain within separate vehicles spaced at least six feet apart (or ten feet apart if singing by audience members is anticipated) so long as no food, drink, or other goods are passed between vehicles. c. The gathering limitation does not apply to daycares, day camps, or educational institutions for grades pre-K through 12. For capacity limitations for daycares and day camps, see Emergency Order 10, Attachments and F. Educational institutions with grades pre-K through 12 are subject to an indoor capacity limitation of 50% of building occupancy based on building and ?re codes. (1. The gathering limitation does not apply to gathering for the purpose of worship or political expression where masks are continuously worn and where food and drink are not being consumed. Places of worship and political expression are instead subject to a 50% indoor capacity limitation based on building and ?re codes, and physical distancing should be maintained continuously between people who are not members of the same household/small chosen closed group. All places of worship and political expression that are open to the public for gatherings must create written mitigation plans, maintain hard copies on site, make the plans available to congregants or other visitors, and train staff on implementation of the plans. ?0-14 v3 11/6/2020 pg. 3 Municipality of Anchorage Austin Quinn?Davidson, Acting Mayor e. The gathering limitation does not apply to athletes during organized sports practice or competition (whether or not affiliated with a school or camp). Organized sports are instead subject to the criteria required in Attachment B. Spectators are not permitted unless the total number of individuals in attendance, including athletes and staff, does not exceed the above gathering limitations. f. The gathering limitation does not apply to indoor shopping special events, such as holiday bazaars. These entities are instead subject to the limitations and other criteria in Attachment C. Hospitality Industry (Including Bars, Breweries, Restaurants, and Limitations. All restaurants, bars, breweries, and and similar entities may provide sit-down service while operating at no greater than 50% of maximum building occupancy subject to the criteria required in Attachment A. Outdoor service should be prioritized. This industry is also encouraged to offer otherwise lawful takeout, curbside, and delivery service. Indoor Gyms, Bingo Halls, Theaters, and Other Recreation and Entertainment Facilities. All other indoor entertainment and recreation facilities, including gyms, bingo halls, and theaters, shall be limited to 50% of building occupancy based on ?re and building codes. Businesses must calculate allowed capacity, post it publicly, and enforce the capacity limits. Speci?c group events or activities occurring within these facilities (such as classes, parties, games, and competitions) are additionally subject to the gathering limitations and the organized sports attachment, as applicable. Additional requirements for indoor and ?tness centers are provided in Attachment D. Legible Visitor Logs Required. Restaurants, bars, breweries, gyms, bingo halls, and any establishments serving the public in a sit-down setting, or for an in-person appointment or service lasting ??een minutes or longer shall require all adult customers or clients to sign in with legible contact information including ?rst and last name, phone number, and email address in case it is needed for state or local contact tracing efforts. This information may be kept electronically. This information must be retained by businesses for not less than 30 days. Information in the visitor log will not be collected unless needed for contact tracing or enforcement of this order. Communication to Employees and Others of Known COVID-19 Exposure Required. All businesses and other entities must communicate to their employees and state and local public health departments (email: COVID-19- Business@anchorageak.gov) if a known or probable exposure occurred in E044 V3 pg. 4 10. ll. Municipality of Anchorage Austin Quinn-Davidson, Acting Mayor the workplace. Businesses and other entities must assist the state and local health departments in the process of informing customers or clients of a known exposure at the workplace. Additional Requirements for Hotels and Other Lodging. Management at hotels and other places of lodging must regularly inform employees working within the lodging and state and local public health departments whether and to what extent the hotel is housing individuals who are in quarantine or isolation due to travel, possible exposure to COVID-19, or a diagnosis of Hotel management must inform employees that the names of individuals with COVID- 19 shall be kept con?dential, and that a violation of con?dentiality may result in disciplinary action by management. Hotels must supply personal protective equipment, suf?cient sanitation opportunities, and adequate cleaning supplies to employees. Remote Work. Employers are strongly encouraged to have employees work from home when their work can be accomplished remotely without signi?cantly impeding business operations. Employers shall not knowingly permit employees or others likely to be contagious with COVID-19 to enter the workplace or work outside the home. Retail and Other Public-Facing Businesses. Retail stores and all other public-facing businesses are required to limit capacity in a manner suf?cient to permit customers to have six-feet of physical distance from other household groups. These businesses are encouraged to prioritize telephone and online ordering; increase their offerings of curbside, and delivery services; and implement reserved hours of operation limited to high-risk populations. All portions of Emergency Order 10 (?Maintenance?) and its attachments that have not been contradicted or superseded by this order remain in effect, including requirements for sanitation, physical distancing, and business mitigation plans.
