To amend the District of Columbia Election Code of 1995 to include in local elections a person 18 years of age or more, who has resided in the local government jurisdiction for 30 days or more prior to the next preceding election, and is not a citizen of the United States but a permanent resident of the United States under federal law shall be authorized to vote in local elections. BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this act may be cited as the “Local Resident Voting Rights Act of 2013”. 30 Sec. 2. Section 2 of the District of Columbia Election Code of 1955, approved August 12, 1955 31 (69 Stat. 699; D.C. Official Code § 1-1001.01 et seq.); D.C. Official Code § 3-500.02(b) is amended to 32 read as follows: 33 “(b) Is a citizen of the United States or is a non-citizen resident. A non-citizen resident 34 is defined as a person 18 years of age or more, an occupant in the local government jurisdiction 35 for a minimum of 30 days prior to the next preceding election, and is a permanent resident of 36 the United States in accordance with section 101(a)(20) of the Immigration Nationality Act, 37 approved June 27, 1952 (66 Stat. 166; 8 U.S.C. § 1101(a)(20)), who otherwise qualifies under 1 1 the other provisions in D.C. Official Code § 1-1001.02(2), shall be legally authorized to vote in 2 local elections. Authorized elections include elections for the Board of Education, Advisory 3 Neighborhood Commissions, the Attorney General, the D.C. Council, the Mayor, and any voter 4 initiatives and referendums. 5 Sec. 3. Rulemaking authority. 6 The mayor shall, within 180 days of the effective date of this act, promulgate rules in 7 accordance with this act, such rules to include the proper design of a ballots, voter registration lists, and 8 the conduct of an election whereby resident aliens shall vote for candidates in elections for the Board of 9 Education, Advisory Neighborhood Commissions, the Attorney General, the D.C. Council, the Mayor, 10 and any voter initiatives and referendums. 11 Sec. 4. Fiscal Impact Statement. 12 The Council adopts the fiscal impact statement of the Budget Director or the Chief 13 Financial Officer as the fiscal impact statement required by section 602(c)(3) of the District of 14 Columbia Home Rule Act, approved December 24, 1973 (87 Stat. 813; D.C. Official Code § 1 – 15 206.02(c)(3)). 16 Sec. 5. Effective date. 17 This act shall take effect following approval of the Mayor (or in the event of veto by the Mayor, 18 action by the Council to override the veto), and 30-day period of Congressional review provided in 19 section 602(c)(1) of the District of Columbia Home Rule Act, approved December 24, 1973 (87 Stat. 20 813; D.C Official Code § 1-206.22(c)(1)), and publication in the District of Columbia Register.
