Bruce Fein Associates, Inc. 722 Street, N.W., 4th Floor Washington, D.C. 20005 Phone: 703-963-4968 June 27, 2013 Honorable Eric H. Holder United States Attorney General United States Department of Justice 950 Avenue, NW Washington, DC. 20530-0001 Re: Voluntary return of Edward J. Snowden to the United States for trial in United States ofAm,erica v. Edward J. Snowden, Case No. 1:13 CR 265 (CMH) (E.D. Va.) Dear General Holder: I represent Lonnie G. Snowden, the father of Edward J. Snowden. We believe you share our objective of securing Edward's voluntary return to the United States to face trial in the above-referenced matter. Mr. Snowden is reasonably confident that his son would voluntarily return to the United States if there were ironclad assurances that his constitutional rights would be honored, and he were provided a fair opportunity to explain his motivations and actions to an impartial judge and jury in the above-referenced prosecution. Accordingly, we are requesting that you represent the following to me or to Edward in writing to encourage his voluntarily return to the United States: 1. He would not be detained or imprisoned prior to trial. 2. He would not be subject to a gag order. 3. He would be tried in venue of his choosing. You would also guarantee that in the event any of the three representations were dishonored, the above-referenced prosecution would be dismissed with prejudice. With these written representations and guarantee, Mr. Snowden is reasonably confident that his son could be persuaded to surrender voluntarily to the jurisdiction of the United States to face trial. If you agree in principle to this approach, I would be eager to collaborate with the Department to draft acceptable language, including a non-circumvention clause Thank you for your consideration. Sincerely, Bruce Fein Counsel for Lonnie G. Snowden
