Let me just briefly summarize the 3 conduct here, and then I'll call both of the 4 respondents to affirm their affidavits. 5 Mr. Murphy and Mr. Campbell are now and 6 have been for some time Assistant U.S. Attorneys 7 Central District of Illinois in the Peoria office. 8 In 2004 they were prosecuting a drug case in 9 federal court against a defendant named Paul 10 Childs. The evidence that they planned to present 11 included the testimony of an Allen Logsdon. 12 Logsdon was an informant, a cooperating witness. » 13 He participated in what they call 14 controlled buys, which is where the police give 15 the, Mr. Logsdon funds to purchase cocaine, and 16 that‘s what he did. Prior to the trial, I think 17 three days, two or three days before, Logsdon had 13 a conversation with a detective where he said that 19 he had kept some of the cocaine that he purchased; 20 he hadn't passed it all on to the police. 21 The detective made the respondents, 22 particularly Mr. Campbell, aware of that, 23 Mr. Campbell made Mr. Murphy aware of that. 24 Logsdon later told Mr. Campbell the same thing. h Page 5 Baldwin Court Reporting & Legal Video Services 1-800-248-2835 2/15/07 In The Matter of Bradley W. Campbell h 1 Under well-established precedent, it's clear that 2 the respondents had a duty to disclose the 3 information they learned, they did not do it, and 4 that's the basis for the charges here today. 5 And when I summarize the aggravation and 6 mitigation, I think it will be clear that there is 7 significant mitigation in this case. I‘m going to 8 now after Mr. Northrup addresses you call each of 9 the respondents to have them affirm their 10 affidavits, and if the panel has any questions or 11 concerns, they can address those. I 16 just wanted to state on the record that in terms 17 of the petition, we believe the facts are 18 accurate. With respect to the law that's cited in 19 the petition, we think it's appropriate. 20 There are a few other issues that I feel 21 are important to say here at the hearing even 22 though they're in the petition itself.
