1Michael D. Fayette, P.E. 45793 Otter Street Alexandria Bay, New York 13607 January 30, 2013 The Honorable Andrew M. Cuomo Governor of New York State NYS State Capitol Building Albany, New York 12224 Dear Governor Cuomo: My name is Mike Fayette. I am currently the New York State Department of Transportation (NYSDOT) Essex County Resident Engineer. I say currently because I will soon be retiring (February 8, 2013) involuntarily. I have enclosed a letter I sent to the NYS Inspector General outlining my situation. I've also included several "news clippings" obtained from the NYSDOT IntraDot (NYSDOT internal web page). Included in those news clippings is the Adirondack Daily Enterprise newspaper article where I was quoted that started this entire mess. I have also included a copy of the article in the Plattsburgh Press Republican which added to my situation. I have tried to make contact with the NYSDOT Commissioner in an effort to explain myself. The first time, before doing so, my attorney first checked with Ray LaMarco, NYSDOT Employee Relations to get permission. After getting permission, I sent the enclosed email to the Commissioner. I have not received a response from her, but did receive a harsh response from Mr. LaMarco. On January 7, 2013, during a telephone conversation with my Regional Director, Sam Zhou, Mr. Zhou told me that he had spoken to the Commissioner about my situation. According to him, she knew nothing about what was happening to me. He suggested that I reach out to her again, and that she would be sure to respond. Enclosed is my email to her. She has not responded. Governor, I hope you can sense my frustration about this entire situation. I hope you can also sense that I love working for the NYSDOT and wish to continue my career. Unfortunately, road blocks have been placed such that, due to threats, harassment, and outright bullying, I have been forced to submit my retirement papers (far, far sooner than I had intended). I am pleading for you help with this. I am available at any time, on any day, to discuss this. I would be more than happy to drive to Albany to do whatever I can do to clear this up. I have been praying for "cooler heads" to prevail. I hope that you are that person. Very truly yours, Michael D. Fayette, P.E.
