You were also charged for Attempted Murder, Assault with a Weapon, Assault Causing Bodily Harm, Possession of a Firearm and Fail to Provide the Necessities of Life. These charges stemmed from incidents against your mother. You denied these charges and felt that her mental health issues contributed to those toeing levied against you. Those charges have been Your criminal record dates back to 1988 and includes one prior conviction for- Assault as well as convictions for property type offences. Substantial oonviotion free periods are noted. You served periods of probation and intermittent sentences ; and other than one failure to comply, your behavior during those periods was considered appropriate . From a review of the available information regarding- your personal and social history, the Board learns you suffered a difficult childhood which included both physical and emotional abuse. At your hearing1 today, the Board began fay examining: the circumstances which led to yovnr offences . You explained how the relationship with your victim began on a. positive note. At one point, you loaned her some money with the expectation that she would repay you. On the day of the offetnces r you. had spoken to her about ire--paying you and the conversation digressed to the point that you went to her residence with the intent of getting some money. You admit that you threatened her, assaulted her and. forced her to withdraw some money for you. You acknowledge that this has been very traumatic f or her. This is not the first time you have lost control of your temper and become aggressive. When you perceive you are not being treated fairly or with respect, you have acted out aggressively. You provided an example of road rage whereby you approached another driver with an axe, after you felt he cut you off. In earlier years, you admit to engaging in fights as a way of getting respect from other's . You also admit to having difficulty in other personal relationships but deny that you ever resorted to violence even under stress, when you perceived you were being treated unfairly or disrespected. However, you were abusive which included name calling and threats . This behavior clearly demonstrates that you have a. pattern of abuse within your intimate relationships. Your behavior also speaks to your anger control issues. The Board examined your motivation for your previous offences; . You explained how you would purchase goods from others, knowing they were likely stolen, and would re--sell them. You acknowledge that you engaged in other similar transactions foir which you were not charged. The Board also looked at the charges related to your mother. You deny any inappropriate behavior towards her and emphasized she recanted the allegations prior to her death. In regards to the allegations that you abused her, you denied those as well and blamed dysfunction within your family unit as motivation for these events. You were adamant that these events never occurred and owere concocted by other family members -with the intent to cause you. difficulties . At your hearing, you acknowledged difficulties with anger and other emotions. During this period of incarceration, you participated in a violence prevention program. You recognize your risky situations and you were able to explain new ways in which you will deal with such situations without resorting to violence, intimidation or aggressiveness, You provided some examples of how you have used timeouts and other techniques to deal with situations in appropriate ways, even when you felt disrespected or treated unfairly. Your institutional behavior has been positive in some respects but also concerning in others. At one point, you divulged infomtation on illicit activities and were forced to go to segregation for your own protection. In regards to the homemade weapon, you deny knowing it was in your mattress and believe it was planted there in an effort to get you in trouble and to have you removed from the general population. This version of events was confirmed by staff. As a result of your behavior, you were not well respected by other inmates. In other respects, you transferred to your current MfcHBMHl JMMHMMV institution, resided in a drug free unit and did not involve yourself in any violent incidents. You advised that you used programming skills to avoid violent confrontations. Given the absence of documented incidents related to violence, it seems that you are able to effectively use your new found skills. As a result of your overall positive performance and progress vis-avis addressing your contributing f aatozre, you have confirmed acceptance for residency on day parole. You also understand, the need for the proposed special condition. In regards to repeating such behavior, you wore adamant that you will not- re-act violently in similar situations. You feel that the skills you have learned and the deterrent affect of incarceration will enable you to achieve this goal. The Board has carefully considered all information in your case. It acknowledges your history which is inclusive of violence. While incarcerated, you have complied with your correctional plan and addressed your contributing factors. Today, you were able to demonstrate how you have used these skills to avoid reacting aggressively in challenging situations. You are assessed as a low risk to re--offend and your release plan, will assist to further mitigate your risk fay providing structure and supervision. Given these factors, the Board is satisfied that you do not present an undue risk to public safety. Furthermore, your release at this point will facilitate your rein.tegra.tion. into society as a. law-abiding citizen. Consequently, day parole is granted. REASONS FOR SPECIAL CONDITION IMPOSED ON YOUR DAY PAROLE AND STATUTORY RELEASE: During these offences, you showed a callous disregard for your victim. You threatened, assaulted and extorted money from her. These events were very traumatic for her and caused a considerable amount of fear. It is likely that your actions will have a long lasting negative Impact on her. As she works towards getting her life back on track, any contact with you would constitute a serious setback and may further traumatize her. Furthermore, any further contact with her could potentially increase your risk to reoffend. In this vein, you are prohibited from any direct or indirect contact with the victim of your current offences -- K.H. This special condition is deemed reasonable and necessary in order to protect society and to assist/facilitate with your successful reintegration. It is valid until your warrant expiry date.
