INDICTMENT COUNT 1 The Grand Jury charges that, from on or about October 2, 2012 until October 31, 2012, the date of arrest in Hollywood, Florida, within the Eastern District of Tennessee and elsewhere, the defendant, TAMRAL GUZMAN, having been released pursuant to the Bail Reform Act of 1966, with the condition requiring her appearance in all court proceedings before the Honorable Judge Varlan, in case number entitled United States v. Tamral Guzman, did knowingly and willfully fail to appear as required, in violation of 18 U.S.C. 3146(a)(1). COUNT 2 The Grand Jury further charges that on or about October 2, 2012 until October 31, 2012, the defendant, BRIAN PAUL HATCHER, knowing that an offense against the United States had been committed, to wit, Conspiracy to without authority dispense, distribute, possess with intent to distribute and dispense schedule II and IV controlled substances outside the usual course of professional practice and without a legitimate medical purpose in violation of21 U.S.C. 846, 841(a)(1), did receive, Case 3:12--cr-00153 Document 1 Filed 11/06/12 Page 1 of 2 Page|D 1 relieve, comfort, and assist the offender, TAMRAL GUZMAN, in order to hinder and prevent the offender's apprehension, trial, and punishment, in violation of 18 3. COUNT 3 The Grand Jury further charges that on or about October 31, 2012, the defendant, BRIAN PAUL HATCHER, did knowingly threaten to cause bodily injury to GB by communicating to GB by telephone and text messaging threats of bodily harm, such conduct being taken with the intent of retaliating against GB for any information given by GB, to law enforcement officers relating to the commission of a Federal offense, namely 18 U.S.C. 3146(a)(1) Failure to Appear, all in violation of 18 U.S.C. 1513(b)(2).
