II Mrefi SUPERIOR COURT FOR THE DISTRICT OF COLUMBIA CRIMINAL DIVISION UNITED STATES CHAVEZ MYERS NOV. 19. 2012 On Saturday, November 2012, at approximately 01:1? hours, members of the Metropolitan Police Departmentfisecond District Scout car 2041 and 2044 were dispatched to the Woodley Metro Station located at 2560 Woodley Road Northwest, Washington, DC 204} in reference to a stabbing. Upon their arrival they were met by members of Metro Transit Authority Police who directed them to the Mezzanine platform where they found the decedent, identified as Dlijawon Emmanuel Griffin, described as a black male, DOB: 09/lfiflfias, suffering from an apparent stab wound to the chest area. The decedent was transported by DCFEMS to George Washington University Hospital where members of the medical staff performed life saving measures. These efforts proved to be futile and the decedent was pronounced dead by Dr. Paul Lin at 0202 hours. The decedent was transported to the District of Columbia's Office of the Chief Medical Examiner's located at 1910 Massachusetts Avenue Southeast, Washington, DC for the purposes of an autopsy. During the course of their investigation, there was another individual located that appeared to be the victim of an assault. This person, hereinafter referred to as the "complainant," was transported by DCFEMS to George Washington Hospital suffering from a fractured nose; however, the injury is non-life threatening and the complainant has been admitted and is in stable condition. Police investigation revealed the following information. According to a witness, hereinafter referred to as W--1, on Saturday, November 2012, shortly after midnight, IT was with the decedent and the complainant in the 1300 block of Columbia Road Northwest, Washington, DC. W--1 indicated that IT observed the decedent speaking to several young black males inside the McDonalds located at 2481-83 18th Street Northwest, Washington, DC. Shortly thereafter, W--1 went to use the bathroom at the McDonald's, while the decedent told him that he was going to leave with the young black males in an effort to buy marijuana from them. Shortly thereafter, W-1 and the complainant left the McDonald's to look for the decedent. When they found him a few minutes later, the decedent stated that the young black males had just robbed him at gunpoint. According to W-1, the decedent, who was visibly angry told W-1 and the complainant that he went with the young black males into an alley adjacent to the Exxon gas station located at 182? W-1 noticed a contusion under the decedent's and an abrasion on his elbow. After telling W-1 and the complainant what happened, all three individuals proceeded to walk to the Woodley Park Metro Station located at 2660 Woodley Road NW so that they could take the Metro home. While in the Metro station, the decedent observed, in the lower level platform waiting for a train, the approximately 10-12 young black males who had been involved in robbing him. One of them was wearing the decedent's Helly Hansen jacket. The decedent identified them to W--1 and the complainant, at which point all three men went down the escalator to the platform. The complainant and the decedent approached the young black males, while W--1 stayed near the escalator. The decedent approached the subject wearing his jacket and stated, "Give me my jacket back!" The subject wearing his jacket replied, "You're going to have to see us!" W-1 said the decedent stated, "What, I am not a bitchi" It was at this time all of the 10-12 subjects started moving towards the complainant and the decedent. While several members of the group assaulted the complainant, W-1 and the decedent started to go back up the escalator towards the station manager's kiosk. As they did so, one of the subjects brandished a knife at the decedent, who was unarmed. shortly after making it up the escalator. the decedent told W-1 that he was going back to help the complainant, who was outnumbered and being badly beaten while lying on the platform. W--1 stated that as IT spoke to the station manager in the kiosk and asked the manager to call the police, IT briefly lost sight of the decedent. Your affiant reviewed recorded Metro security camera footage of what happened while W--l lost sight of the decedent. The security camera footage shows the decedent approaching several of the young black males and saying something to them. The males approach the decedent, and one of the males and the decedent square off, put their fists up, and start punching each other, moving around in boxing-style motions as they do so. While the complainant's back is turned, the defendant, later identified by word of mouth as Chavez Myers, can be seen sneaking up behind the decedent while carrying a knife. He confessed to having stabbed the decedent but claimed to have done it in self--defense, despite the fact that the video clearly shows the decedent was engaged in an unarmed fistfight with another person. that he came up from behind the decedent and stabbed him in the chest as The defendant denied participating in the robbery of the decedent earlier that night but admitted to participating in the assault on the complainant, by kicking him with a shod foot and punching him, on the Metro platform.
