SUPERIOR COURT FOR THE DISTRICT OF COLUMBIA CRIMINAL DIVISION UNITED STATES V5 03, 2012 LEON A SMITH On Sunday, September 2, 2012, members of the First District Police Department received a radio run for an Aggravated Assault that occurred in front of 203 Street, Southwest. MPDC Officers arrived at that location and observed a blue SUV with the passenger side door open in front of 203 Street, Southwest. Officers observed an individual, later identified as W--1, in the passenger seat holding right hand on the left side of the chest of the decedent who was in the driver's seat. The victim had a visible stab wound to his left chest area and was unconscious but breathing. Emergency Medical services personal responded and transported the victim to George Washington Hospital where he (hereafter referred to as "the decedent") subsequently succumbed to his injuries. The decedent was pronounced dead by Dr. Pirri of George Washington Hospital staff. During the course of this investigation, a witness was located and interviewed who will hereafter be referred to as Wwl. W--1 stated IT was at home in Capitol Heights, MD along with W--2 and the decedent. Wel stated W-2 asked W--l and the decedent to drop IT off in Southwest, Washington, D.C. at the defendant's residence. The decedent drove W1 and W2 to 203 Street Southwest, Washington, DC. W--l stated once they arrived, W--2 exited the rear passenger seat of the vehicle and gave IT a hug and then walked around to the driver's side of the vehicle and gave the decedent a hug. W-1 stated IT then observed the defendant approach the driver's side of the vehicle and appear to punch the decedent once in the chest. W--1 stated IT then observed blood coming from the decedent's chest and heard the decedent say "He just stabbed me!" W--l immediately called 911 and began to render assistance to the decedent in an attempt to stop the bleeding. During the course of this investigation another witness was located and interviewed who will hereafter be referred to as W-2. W--2 stated IT was inside of a residence with W--1 and the decedent when IT asked W--l and the decedent to drive to 203 Street Southwest, Washington, DC to meet the defendant, Leon Smith. W--2 stated that upon arriving at 203 Street Southwest, IT advised the defendant via text that IT was out front of the building and asked the defendant to come and meet IT. W--2 stated that as IT exited the vehicle, IT hugged both W- 1 and the decedent. W-2 stated the defendant had a look on his face as if he was upset as he approached the decedent. W-2 stated IT observed the defendant walk up to the decedent and state: YOU TRYING TO TALK TO MY GIRLFRIEND, W-2 then observed the defendant punch the decedent in the chest with a closed fist one time and walk away. After the punch, W--2 observed the defendant holding a silver knife with a blue handle in his right hand. W-2 observed the decedent bleeding from his chest area and heard him say, MY HE STABBED W--2 stated IT then began to follow the defendant to prevent him from escaping. W-2 stated IT heard an object strike the ground in the area where the defendant was walking. stated IT observed a marked MPD cruiser pull into the block and IT pointed the police in the defendant's direction. W--2 also directed the police to the location where IT heard an object hit the ground Based on the observation of MPD officers located a silver knife with a blue handle on the ground matching the knife which W2 observed in the decedent's hand after he stabbed the decedent. W--2 was shown a single confirmation photograph of the defendant. W-2 viewed the photograph and positively identified the defendant as Leon Smith, the person whom IT observed stab the decedent on Sunday, September 02, 2012, in the 200 block of Street Southwest, Washington, D.C. During the course of this investigation a witness was located and interviewed who will hereac. Police Officer that was on duty in full uniform. W--3 stated he received a radio run for an Aggravated Assault that just occurred at 203 Street, Southwest. Upon arriving on the scene he observed a black female, W--2, screaming, crying and pointing at the defendant, who was walking away from the crime scene. W--3 stated that as the defendant was walking away he observed the defendant toss an object to the ground with his right hand. W--3 stopped the defendant and after securing him, asked W--2 "What was going on?" then immediately stated "He just stabbed my girlfriend's boyfriend." At the time of his arrest, members of the Metropolitan Police Department interviewed the defendant, Leon Smith. The defendant stated that he observed the W-2 kissing and hugging the decedent and that he approached the decedent and punched him in his chest. The defendant initially stated that he did not think he stabbed the decedent. He believed he only punched the decedent. Defendant was arrested on probable cause and charged with Second Degree Murder.
