BRONCOS LAW ON BEHALF OF ADAM HEROLD, the Herold family wishes to make the following statement: On April 6, our lives changed forever. Since that evening, our family has been living minute to minute, trying to cope with the tragic loss of our beloved son, Adam. We think of Adam all day, every day. We are reminded of our loss everywhere we turn and would do anything to go back in time to the way we were. Grief, worry, guilt, anxiety and loss have taken over our lives as we continue to mourn and try to deal with this tragedy. We are pleased that the process to hold the driver of the semi accountable has begun and are hopeful that those responsible for this catastrophe are brought to justice in accordance with the Laws of Canada and Saskatchewan. We also have broader concerns we believe need to be addressed. These concerns include licensing and truck safety for first time inexperienced drivers who are travelling interprovincially and hauling large loads with difficult-to-control trailers. Secondly, we have concerns about highway safety throughout Canada and Saskatchewan and bus safety for all passengers. Lastly, we believe that changes are needed to allow victims and their families impacted by these senseless acts to pursue full compensation against those responsible in our courts of law. No family should have to go through what we are enduring. Our family loved each other, supported each other and did everything together – that’s what families are supposed to do. Adam’s death has taken this from us and we hope that by pursuing this legal action, no other family ever will have to experience the excruciating grief and profound sense of loss that has overtaken our lives since April 6. Our goal with this legal action is to invoke change for not only our son Adam and his Bronco teammates, but that all people affected by this senseless and tragic event benefit from changes in laws and attitudes for the betterment of society as a whole. We ask that our governments and others in power make the following changes so that another bus crash does not take the lives of one more child, brother, grandson, nephew, classmate and friend: Our first goal is to ensure all major through highways (where drivers are not expected to stop or required to stop) are safe for all travelers, including highway 35. A driver on a major highway in Saskatchewan or Canada should not have to rely on the conduct of another driver approaching an intersection with a stop sign to ensure the safety of his own family. The sightlines at the Armley Corner intersection for those travelling north on highway 35 were not sufficient to allow the bus driver to take evasive action to save the Humboldt Broncos. If a driver travelling west on highway 335 intentionally, recklessly or negligently decides to disregard the driving laws of Saskatchewan and runs the stop sign, travelers on highway 35 are in serious jeopardy of being involved in another potentially deadly accident. We therefore ask that highway 35 and all through highways are made safe so that those travelling have the requisite sight lines to see approaching vehicles so that evasive action can be taken to avoid an accident if another vehicle does not adhere to the rules and regulations governing highway travel. This should be built into the design and maintenance of all other major through highways. Our second goal is to ensure passengers riding on all buses are safe and are equipped with reasonable safety devices to prevent passengers from being ejected from the bus. We therefore ask that all buses carrying passengers be designed to have the roof stay on in the event of a collision and that shoulder harness seat belts and early warning safety devices be designed into the manufacture of all new buses to minimize injury and prevent the ejection of passengers from the bus in the event of an accident. Our third goal is to ensure all drivers of commercial vehicles that use Saskatchewan or Canadian highways are competent and skilled. Laws need to be enacted to ensure only the most competent drivers operating or driving semi-trailer units that pull hard-to-operate and maneuver trailers are authorized to operate such vehicles and trailers. We therefore ask that our lawmakers review the laws of Saskatchewan and Canada to enact laws that ensure only the most skilled drivers operate large commercial vehicles that pull difficult-to-operate trailers and attachments on our highways. Our fourth goal is to review the laws of Saskatchewan that hinder or prevent those affected by such senseless acts from pursuing compensation against the drivers of vehicles and those responsible that intentionally or pursuant to conduct that is grossly negligent. This includes the ability to make claims for full compensable damages, including those related to pain and suffering. We therefore ask that our lawmakers review in a timely manner, the Automobile Accident Insurance Act and the Fatal Accidents Act to ensure the victims of senseless acts and their families have the right and ability to pursue the wrongdoers for full compensation for all damages in a court of law. The support our family has received from the public since the accident has been overwhelming. Our family, friends and complete strangers continue to reach out and support us as we navigate through this heart wrenching journey we never ever envisioned we would have to experience. We appreciate all of the support and messages of sympathy and simply say ‘thank you’. We know that a change in laws won’t bring Adam or the other 15 lives lost back to their families where they belong but we believe these changes are the right thing to do.
