This case is  today fixed for  arguments  on the application  filed by the accused Vivek Shrivastva seeking bail.  Sh.   Sandeep   Kapur,   Ld.   Counsel   for   accused   Vivek  Shrivastva, Ld. Addl. PP for State, Sh. Mrityunjay Kumar, Ld. Counsel  for complainant, have all been heard on the said application. To put  it  very  briefly,  the  allegations  against  the  accused  Vivek   Shrivastva   are   that   he   along   with   four   other   persons   had  committed   gang   rape   upon   the   prosecutrix   after   drugging   her.     It   is  alleged by the prosecutrix, a resident of US, in her complaint that she  along with a group had come to tour India in April 2016 and that on  08.04.2016, she along with some members of the group of the tour had  reached Park Hotel at about 5.30­6.00 PM where she was welcomed by  the accused Anirudh Singh who was their tour manager and he gave her  the keys to her hotel room and that thereafter she was escorted to her  ( 2 ) room on the 7th floor by a hotel employee whose age was in the late  twenties and, he was about 5.5'', thin and had dark hair.   Accordingly to  the prosecutrix, it was this person/hotel employee who after escorting to  her room came back after 10­15 minutes with a water bottle and that she  after drinking the water from it, felt dizzy and lost consciousness and  then   thereafter   in   the   night,   she   remembers   to   have   been   sexually  assaulted   by   the   said   hotel   employee,   tour   manager   accused   Anirudh  Singh and three other persons.  Now   during   investigation,   the   statement   of   the   Lobby  Manager   of   the   hotel   namely   Sh.   Prashant   Suri   was   recorded   and   he  informed the IO that as per the Bell­Boy register maintained in the hotel,  he had deputed Vivek Shrivastva, a bell­boy of the hotel to escort the  prosecutrix to her room on the 3rd floor ( as per the prosecutrix, it was  seventh floor).   Based on this statement, Bell­Boy Register, and the call  detail records of the phone of this accused, he was arrested.  During the  TIP   proceedings,   however,   the   prosecutrix   failed   to   identify   him   and  therefore,   now   bail   is   being   sought   on   his   behalf   on   the   ground   that  firstly, the description given by the prosecutrix of the hotel employee  who had escorted to her room does not at all match with the physical  description of this accused and secondly, that the prosecutrix could not  even identify him in the TIP proceedings.  The   bail   is   being   opposed   by   the   Ld.   Addl.   PP   and   Ld.  Counsel Sh. Mrityunjay Kumar on the ground that the allegations made  by the prosecutrix in the present case are very serious and that the mere  failure   of   the   prosecutrix   in   identifying   to   this   accused   during   TIP  proceedings cannot be made a ground for releasing him on bail. It is  ( 3 ) submitted by Ld. Counsel Sh. Mrityunjay Kumar that this Court must  bear in mind that the prosecutrix is a US citizen and she had reported the  incident   after   about   6­7   months   and   had   participated   in   the   TIP  proceedings on 27.12.2016 i.e. about 8 months after the incident   and  therefore, may not have been able to identify the accused.   Ld. Addl. PP has also contended that the statement of Lobby  Manager Sh. Prashant Suri also reveals that it was this accused who had  escorted the prosecutrix to the room. In rebuttal, Ld. Counsel Sh. Sandeep Kapur has submitted  that the mere fact that the prosecutrix was made to participate in the TIP  proceedings after about 08 months of the incident and that therefore, her  memory may not be perfect is no ground to deny this accused the liberty  of bail more so when the prosecutrix has been able to identify the other  three accused persons in this case and therefore her memory lapse cannot  be taken to be selective in this sense.   Having carefully considered the submissions made by Ld.  Counsels and the entire record, this Court is of the considered opinion  that   the     accused   Vivek   Shrivastva   is   entitled   to   be   released   on   bail  keeping in view that this accused was about 38 years of age as on the  date of the incident, is a well built, podgy person and is also almost  completely  bald  and  therefore  his  physical  description  does   not  at  all  match the description given by the complainant of the person who had  escorted   to   her   to   the   room   and   had   given   her   drugged   water   on  08.04.2016. As narrated herein above, the said person, according  to the  prosecutrix, was in his late twenties, thin and had dark hair.   Clearly, the  accused Vivek Shrivastva, present in the Court, does not at all fit this  ( 4 ) description.  It is this fact coupled with the fact that the prosecutrix failed  to  identify  him  during  the  TIP proceedings  which  has  persuaded  this  Court  to hereby  hold  that  this  accused  at  this  stage,  is  entitled  to be  granted the benefit of bail.  Accordingly, this accused is hereby directed  to be released on bail subject to his submitting bail bonds in the sum of  Rs. 25,000/­ with one surety in the like amount.   It is made clear that  accused shall not leave the country without the permission of this Court  during the trial.  The bail application stands disposed off accordingly.
