Dear Governor Gregoire, Thank you for your exceptional service to the State of Washington. Your leadership in helping to end the 2012 legislative is also appreciated. On behalf of the City of Kirkland, I am writing to express our concerns with two sections of ES1-IB 2823, Redirecting existing state revenues into the general fund. Specifically, we request a veto of Section 4 of ESHB 2823, which permanently redirects Si 0 million per year from liquor excise taxes into the state's general fund. This shift nullifies the $10 million increase in liquor revolving fund distributions from Initiative 11 83. Cities have historically relied on liquor revenues, which have been shared for over 70 years. due to the impacts of alcohol consumption on public safety and health costs at the local level. Those impacts will not be going away. In the City of Kirkland, the number of licensed liquor retailers is projected to increase from 3 to over 21. These projections raise a real concern that the impacts of alcohol consumption will increase with the passage of Initiative 1183. We support and appreciate the proviso included in Sections 101 and 102 of 3ESFIB 2127, the supplemental operating budget. These sections establish and direct a joint select committee to review the impact of Initiative 1183 on public safety needs and provide a sustainable plan for utilizing excess liquor revenues. Similar to the AWC, we believe it is premature to redirect liquor revenues beyond this biennium until this effort concludes. In addition, we request a veto of Section 2 of ESI-IB 2823, which redirects all of the solid waste tax (RCW 82.18.040) to the general fund through 2015 and one-half of the solid waste tax to the general fund from 2016 through 2018. The result being over $200 million in reduced funding to the Public Works Assistance Account, which has historically helped provide funding to build and maintain city infrastructure and provide jobs. Cities expected to be part of the state's budget solution in this fiscal crisis, with the goal that any cuts be temporary. In January, at the AWC's Legislative Action Conference you commented that you would consider making any cuts to local governments temporary rather than permanent. This is a real problem, and one which stakeholders such as myself, have worked to address for a number of years. While it might provide temporary relief for a few marinas in Tacoma and on the San Juan Islands for one-year, it only kicks the can down the road" in solving the problem of how rent is inequitably applied to those of us who lease aquatic lands from DNR. I realize this issue has been worked on for sometime. While many of us may not have been happy with SB 5550 which addressed this issue in the last biennium, at least it was debated in the open and not stuck in the budget in the last minute without input. This section requires the Department of Natural Resources to "promptly redetermine annual rent" for marinas that meet a very specific definition. The section should be vetoed for several reasons, including: having a potentially negative impact on the Aquatic Lands Enhancement Account (ALEA); o providing a beneficial procedure to a very limited number of marinas that is not available to all the o marinas falling outside of the very narrow definition; making determinations on annual rent for a select few marinas and not providing the needed o comprehensive review of the current antiquated rent system. As Chair of the House Capital Budget Committee, I am very concerned about the impact on ALEA that would result from implementation of Sec. 308 (12) (a). The Legislature created ALEA in 1984 to ensure that revenue generated from state-owned aquatic lands leases would be used to help restore aquatic lands and the environment. In the Capital Budget we have been able to fund projects such as restoring shorelines for salmon habitat, removal of bulkheads, restoring estuaries, etc. As you know, there is no shortage of work that needs to be done. I understand that the existing leasing system has problems and is considered out of date and probably should go to a market-based system. However, Sec. 308 (12) (a) is not the answer and should be vetoed. A comprehensive review of the marina lease system should be undertaken to ensure the health of ALEA and aquatic land restoration and fairness to all marinas in all parts of Washington.
