Hon'ble Manoj Kumar Gupta,J. The petitioners herein want to appear in CLAT 2014 examination being conducted by respondent No. 2. However, they are unable to fill in their application online as the same is not being accepted for the reason that the petitioners have crossed the upper age limit of 20 years. Learned counsel for the petitioners submit that the upper age limit of 20 years prescribed by Clause 28 Schedule III Rule 11 of the Rules of Legal Education, 2008 framed by Bar Council of India, has been withdrawn by Notification dated 28.09.2013 and, thus, at present there is no such restriction. However, computer data has not been upgraded with the result that the application of the petitioners is not being accepted. Vide order dated 07.04.2014, this Court permitted the petitioners to serve the respondents by Speed Post within 24 hours. In pursuance thereof, the petitioners have taken steps for serving the said respondents by Speed Post. Office report dated 22.04.2014 indicates that notices issued to respondent Nos. 1 & 2 by Speed Post have not been received back so far. On 22.04.2014, the case was adjourned awaiting service of notice on the said respondents. However, even today, no one has appeared on behalf of the said respondents. Since, notices sent to these respondents by Speed Post have not been received back unserved, therefore, service on the said respondents is deemed sufficient as per Rules of Court. Learned counsel for the petitioners in support of her contention has drawn the attention of the Court towards Notification dated 28.09.2013 by Bar Council of India (S.A. 1), which specifically mentions that in view of various decisions by different High Courts, the prescription of age limit of 20 years vide Rule 11 is unconstitutional and against the principles of natural justice and therefore, the said Rule is being withdrawn. -2In view of the above, the petitioners, who are stated to be beyond 20 years merely by 28 and 120 days respectively, would be entitled to appear in the CLAT 2014 examination, provided they fulfill other eligibility parameters. Accordingly, an ad-interim mandamus is issued to respondent No. 2 to permit the petitioners to appear in CLAT 2014 examination on their presenting the certified copy of this order before the Director/Convener of Organizing University namely, Gujarat National Law University, Gandhinagar, Gujarat, within a period of one week from today or to show cause by filing a counter affidavit before the next date.
