We have completed the examination of your complaint in lhe above
mentioned file,

i wish to inform you that we refuse, according the law, to proceed any
further in this matter for the following motives:

- The complainant, Mr. Jeffery Pokora, filed
Commissioner regarding the conduct of officer

This complaint deals with the circumstances surrounding a traffic
accident. Besides the aggresswe attitude of the police officer involved, the
complainant alleges that the latter bumped into his car at least twice,
which resulted in dangerous chase [File No, 134501 14702);

-- We carefully examined the allegations ofthc complaint, requested further
details from the complainant and carried out Checks, based especially on
the relevant operational documents,

. It must first be recalled that a police ethics complaint must "deal with the
conduct of a police officer in the performance oi his duties and constitute
a derogatory act to the Code ofefhics";

. It must also he recalled that the Code of ethics of Quebec police officers
applies when a police officer (a wildlife protection officer, a special
constable, a highway controller or a UPAC investigator) is in "the
performance of his duties" and "in his relations with the public";

a llowcver, it emerges from our review that the alleged acts involving the
affected police officer were not committed while he was in the
performance ofhis duties;

- Under these circumstances, the Commissioner no longer has jurisdiction
in this case;

- Therefore, there is no cause to set the ethics process in motion in this
case.
