Police. She and her family cannot return back to her village and have been rendered homeless. The Petitioner has been condemned by the Khap Panchayat to be raped and paraded naked because her brother Ravi fell in love and eloped with her friend and neighbour Krishna who belongs to the dominant caste of Jat. The said affair of Ravi and Krishna invited the wrath of U.P. Police and Jat community as a consequence of which Petitioner’ family members were abducted and tortured by police; her family had to flee their village; her home looted and possessed by the Jats; Ravi had been falsely implicated by the police in a case registered under N.D.P.S. Act after he and Krishna surrendered before U.P. Police. Krishna, an adult, who was pregnant with the child of Ravi has been handed over by the police to her family against her will and is being illegally confined at unknown location and tortured by them and she, very likely, faces honour killing at their hands. The plight of the Petitioner and her family and violation of their fundamental rights is directly attributable to the criminal acts of U.P. Police who instead of protecting the Petitioner, Ravi, Krishna and her family committed atrocities upon them in violation of every law and procedure they are expected to uphold. Unimpeachable evidence of criminal acts of the U.P. Police has been annexed with this petition. Fearing for her own life and honour and also that of her friend Krishna who is pregnant, the Petitioner seeks intervention of this Hon’ble Court for enforcement of her fundamental rights under Article 32 of the Constitution of India. 2012 The petitioner’s brother namely Ravi (a member of the scheduled “Jatav” caste) fell in love with the Petitioner’s friend and neighbor namely Krishna (a member of Jat caste) and started seeing each other. 10.02.15 Krishna was forcibly married against her will by her family to one Sunil Khatri a resident of Haryana after the inter-caste affair became public in the village. 22.04.2015 Krishna left her matrimonial home and came back to her parental home and eloped with Ravi to avoid torture at the hands of her family. 02.05.2015 Due to harassment and immense pressure from the girl’s family, Ravi and Krishna surrendered before Delhi Police at PS: Mehrauli. A Daily Diary Entry bearing no. 79B dated 02.05.2015 at P.S. Mehrauli was made to the said effect and Krishna was sent to Nari-Niketan after medical examination. Police recorded statement of Krishna wherein she stated that she is pregnant with the child of Ravi and faces threats to her life from her family members. 06.05.2015 Krishna was produced for recording of her Statement under Section 164 Cr.P.C. before the Court of Shreya Arora Mehta, Learned Metropolitan Magistrate, who refused to record her statement and thereafter she was handed over to her uncle Krishna Pal despite her express desire to be not handed over to her family. Police had recorded D.D. No.80 B dated 6.05.2015 regarding handing over of Krishna to her uncle. 19.05.2015 Krishna again left her parent’s house with Ravi because of continuous torture. Thereafter the family of the Petitioner again started harassing the Petitioner and her relatives. 21.05.2015 S.I. Aman Singh, Respondent No.3, along with family members of Krishna picked up first cousin of the Petitioner, namely Satish in the middle of the night from Delhi and took him to Baghpat in U.P. without any case having been registered or obtaining warrant of arrest. Satish was kept in illegal custody for 3 days by police and tortured for failing to give information about Krishna and Ravi. Respondent No.3, made a D.D. entry No.4B dated 21.05.2015 at P.S. Welcome regarding taking away of Satish along with relatives of Krishna. Relatives of the Petitioner informed Delhi Police regarding the said illegal abduction of Satish vide D.D. No.15A dated 21.05.2015. 23.05.2015 Satish returned home at night only after a written complaint is filed by the father of Satish with the Assistant Commissioner of Police of PS: Welcome Delhi. 24.05.2015 Petitioner and her family fled their village and came to Delhi apprehending attack from the Jat community of their village as their meetings were taking place in the village. Respondent No.3 family members of along with Krishna forcibly picked up Naresh, uncle of Petitioner from Delhi and took him to Baghpat in U.P. without registered or any case having been warrants having been obtained. No entry was made in PS: Welcome this time as had been done earlier in case of his son Satish. The said incident of abduction up of Naresh was reported to Delhi Police vide D.D. No. 60B dated 24.05.2015 which was verified by Delhi police Vide D.D. No. 71B dated 24.05.2015. Krishna’s uncle namely Sudhir abused and threatened the father of the Petitioner namely Dharampal, with the rape of his sister and the Petitioner herein. Petitioner’s brother namely- Sumit called up Respondent no.3 on his mobile phone regarding the illegal abduction of his uncle and recorded the telephonic no.3 conversation. threatened Petitioner with the false Respondent brother of the implication and dares him to approach this Hon’ble Court for remedy in the said conversation. 25.05.2015 Petitioner’s father lodged a complaint to the Chairperson National Human Rights Commission, informing the commission of the harassment of his family at the hands of the police and family of Krishna. He also lodged similar complaint of even date with the National Commission for Scheduled Castes. Petitioner’s brother namely- Sumit called up Respondent no.3 on his mobile phone requesting him to release Petitioner’s uncle from illegal custody and recorded the telephonic conversation. Respondent no.3 acknowledged the custody of Petitioner’s and promised to uncle release him in the conversation. 27.05.2015 Petitioner’s brother Sumit received a call on his mobile phone from S.H.O. of P.S. Khekra i.e. Respondent No. 2, inquiring about the whereabouts of Ravi and Krishna and in the same conversation acknowledged non-registration of any complaint with the U.P. Police. The Petitioner’s father came to know that Ravi and Krishna have reached the house of the Petitioner’s aunt at Meerut after returning from Vaishno Devi and he immediately takes them to the nearest Police Station i.e. P.S. Medical College at Meerut. Ram Chander i.e. Respondent No.4 takes Ravi and Krishna into custody. 28.05.2015 Respondent No.4 handed over Ravi and Krishna to Respondent Nos. 3,5 and 6 who take both of them in their custody to P.S. Khekra, Respondent District No.4 Baghpat. gives acknowledgement of handing over of Ravi and Krishna to Respondent Nos. 3,5 and 6 on 28.05.2015 at 01:15 hrs in his own hand to the Petitioner’s father. Petitioner’s brother Sumit called up Respondent No.3 at 07:34 hrs. to find about Ravi and recorded the conversation wherein Respondent No.3 suggested that Ravi should be sent to jail. Respondent No.3 registers a false F.I.R. No. 253/15 at P.S. Khekra under section 8 of the N.D.P.S. Act showing that Ravi was arrested by him carrying Poppy husk at 18: 10 hrs., while on patrol duty. Petitioner’s brother Sumit again called up Respondent No.2 at 19: 27 hrs. to find about Ravi and recorded the conversation wherein Respondent No.2 states that Ravi deserves to be sent to Jail for at least 2-3 months at which Sumit pleads with the respondent to show mercy and leniency. Petitioner’s brother Sumit again called up Respondent No.2 at 19: 40 hrs. to find about Ravi and recorded the conversation wherein Respondent No.2 wherein he again pleads with the called up respondent to show mercy. Petitioner’s brother Sumit Respondent No.3 at 20:03 hrs. to find about Ravi and Krishna and recorded the conversation wherein Respondent No.2 acknowledged giving the custody of Krishna to her family. 29.05.2015 Petitioner’s brother Sumit after coming to know that Ravi had been falsely implicated in a case under N.D.P.S. Act called up Respondent No.3 at 20: 32 hrs. and questioned him about false implication of Ravi and recorded the conversation wherein Respondent No.2 acknowledged implicating Ravi falsely and even boasts that he could have implicated Ravi in a graver offence of possession of Cannabis or Opium as was desired by the girl’s family. 30.5.2015 Petitioner’s house was ransacked and looted in the village by the Krishna’s relatives and other member’s of the Jat community and they took possession of the house. Petitioner’s brother Sumit after coming to know about the ransacking of the house called up Respondent No.2 to inform him at 19:03 hrs. and recorded the conversation. He also immediately thereafter called up Respondent No.7 i.e. the S.P. of Baghpat at 19:04 hrs. to inform him about the looting of their house and pleads with him to act. Petitioner’s brother Sumit again called up called up Respondent No.2 to ask about the action taken at 19:53 hrs. and recorded the conversation Respondent No.2 wherein acknowledges that the house has been locked by Krishna’s relatives. Petitioner’s brother Sumit also called up called up Respondent No.3, Aman. to ask about the action taken at 19:55 hrs. and recorded the conversation wherein Respondent No.3 acknowledged that the house has been locked by Krishna’s relatives and informs Sumit that he has taken the keys in his possession. 31.05.2015 Petitioner’s father lodged a complaint addressed to the Chairperson, National Human Rights Commission, informing the commission of the ransacking of his house, harassment of his family at the hands of the police and family of Krishna. 02.06.15 Petitioner’s brother Sumit called up called up Respondent No.3 and recorded the conversation wherein Respondent No.3 informed him that Krishna was about to be remarried. 25.06.2015 Petitioner’s brother Ravi was granted bail by the Sessions Court of Ld. Additional Judge, Atrocities against Women, Fast Track Court, Baghpat vide order dated 25.06.2015. 08.07.2015 The Petitioner and her father went to P.S. Khekra to retrieve documents from their house so as to be able to furnish requisite sureties for Ravi and had to leave the village immediately as they came to know that Jat community was likely to attack them. 30.07.2015 The Jat community had held a “Khap Panchayat’ wherein it has been decided that to avenge the dishonor of Jat community, the Petitioner and her younger sister should be raped and paraded naked after blackening their faces and her family should never be allowed return to their village. 05.08.2015 Hence this Petition. That the petitioner’s brother namely Ravi (a member of the scheduled “Jatav” caste) fell in love with the Petitioner’s friend and neighbour namely Krishna daughter of Ramniwas (a member of Jat caste) and were seeing each other since 2012. II. That Krishna was forcibly married against her will by her family to one Sunil Khatri a resident of Haryana on 10.02.2015 after the inter-caste affair became public in the village. III. That Krishna left her matrimonial home on 22.04.2015 and came back to her parental home and eloped with Ravi to avoid torture at the hands of her family. IV. That due to harassment and immense pressure from the girl’s family, Ravi and Krishna surrendered before Delhi Police at PS: Mehrauli on 02.05.2015. A Daily Diary Entry bearing no. 79B dated 02.05.2015 at P.S. Mehrauli was made to the said effect and Krishna was sent to Nari-Niketan after medical examination. The family of the Krishna again started harassing the Petitioner and her relatives to find about the whereabouts of Ravi and Krishna. VIII. Sub-Inspector Aman Singh, Respondent No.3, along with family members of Krishna picked up first cousin of the Petitioner, namely Satish s/o Naresh Kumar, in the middle of the night from Delhi on 21.05.2015 and took him to Baghpat in U.P. without any case having been registered or obtaining warrant of arrest. Satish was kept in illegal custody for 3 days by U.P. police and tortured for failing to give information about Krishna and Ravi. Respondent No.3 had made a D.D. entry No.4B dated 21.05.2015 at P.S. The relatives of the Petitioner timely informed Delhi Police regarding the said illegal abduction of Satish vide D.D. No.15A dated 21.05.2015 but no action was taken by them to recover Satish. Petitioner along with her family fled their village on 24.05.2015 and came to Delhi apprehending attack from the Jat community of their village as their meetings were taking place to seek revenge for the dishonor brought upon them by the scandal. XII. Respondent No.3 along with family members of Krishna again came to Delhi on 24.05.2015 and forcibly picked up uncle of Petitioner namely Naresh Kumar from Delhi and took him to Baghpat in U.P. without any case having been registered or warrants having been obtained. No entry was made in PS: Welcome this time as had been done earlier in case of Satish. The said incident of abduction up of the uncle of the Petitioner was duely reported to Delhi Police vide D.D. No. 60B dated 24.05.2015 which was verified by Delhi police Vide D.D. No. 71B dated 24.05.2015. A true, typed and translated Copy of D. D. Respondent no.3 threatened the brother of the Petitioner of false implication and dares him to approach this Hon’ble Court for remedy in the said conversation. That the Petitioner came to learn reliably that on 30.07.2015, the Jat community had held a “Khap Panchayat’ in her village wherein it has been decided that to avenge the dishonor of Jat community, the Petitioner and her younger sister raped by the members of Jat community the should be paraded naked after blackening their faces and her family should never be allowed return to their village. 3. That the police has completely abdicated their lawful public duty of providing safety to life, personal liberty and property of the Petitioner under pressure from the influential Jat community. 4. That the U.P. police has been actively participating in criminal acts of abduction of family members of the Petitioner and torturing them in violation of fundamental right of life and personal liberty enshrined under Article 21 of The Constitution of India. 5. That the Police has falsely implicated the brother of the Petitioner in a false case under the N.D.P.S. Act just to teach him a lesson for having an affair with an upper caste woman. 6. And now their acts have so much increased that they have now started beating the doors of my house at village at 2-3 O’clock in the night and they started giving threat to kill us and kidnap and commit rape of my daughters and kill them also and they also started saying that now we will see that who will save you and who will speak against us, and we will not leave him also who will speak regarding us. Because of their such acts, my family members and both daughters are in a great shock and they also could not go out of the house. And they claim that we have good links at the higher levels in U.P. hence you cannot harm us in any manner and the police also cannot do anything against us. On 2.5.15 at around 2.00 p.m., I received a telephonic call of my son Ravi, who was demanding some money from me as he was saying that I am running out of money and I need some money and when in the name of giving him money I asked him to meet, he gets ready to meet me and when I left from my duty and went to meet him at the place, told by him, to Qutub Minar Metro Station, New Delhi, where my Ravi and girl Krishna were already present, and I met them and caught them and made a call at No.100. A PCR Van came there and brought Ravi and that girl to Police Station Mehrauli and in the meanwhile the brother of the girl Krishna was informed at his home that their girl has been found, who is at Police Station Mehrauli. And then IO ASI Dilip Singh recorded statement of the girl according to which the girl stated that being fed up from the daily harassment and beatings of her parents and in-laws, she voluntarily went along with Ravi and she wants to live with him only; and no force has conducted been used medical of upon the her. girl IO from got AIIMS Hospital and handed over the girl to her family members; and Ravi was also released there itself as he was not interested in coming with me. Then the girl started living with her family in the village. On 19.5.2015, the girl Krishna again ran away from her home. And then again her family members started harassing me and my family members by saying that the girl has again ran away because of you. From the same day, the family members of the girl started coming to my home and harassing me an stopping my way and they makes me call and called me here and there and my not reaching there, they manhandle me and comes outside my house and give dirty abuses by saying that “Chamar-Gitthal” and now their activities are so much increased that they came to my house in the night and broken the doors of my house and the say that now we have broken your gate only and we will not leave you also, if your son is not found. We informed this matter to the police. Police rather started blaming me in turn by saying that, “Jyada Bakwas Karega To Hum Tujhe Hi Ulta Band Kar Denge”, they did not hear me and ignored my complaint and they brought me to the Police Station and kept me sitting there for the whole night and entire night my family remained in terror and fear. Welcome, he without any inquiry allowed them to go without seeing any copy of FIR or Warrant. Today on 28.5.2015, I SI Aman Singh along with staff HCP 187 Vijender Kumar Yadav proceeded from the Police Station vide Rapat No.43 time 16.15 P.M. for patrolling, duty of law and order and checking of doubtful vehicles and persons and search of wanted criminals and looking after the area, for which after departure we proceeded towards O.P. School and when while doing patrolling and checking we were coming towards School via village Nurpur on the Delhi-Saharanpur Highway and when we reached near J.B.G. Colony, we saw a man standing in front of the gate of Colony, who after seeing us, the police personnel, became disturbed and turned back towards colony and started walking at fast speed; and we got doubt upon him and on the basis of our doubt we asked him to stop but he did not stop and started walking at more fast speed and then we, police party, ran behind him and used some police force and caught him at around 18.10 P.M. on the road in front of the shops situated in the colony, inside the gate. And when we asked his name, address and reason for walking at fast speed, he stated that his name is Ravi S/o Dharampal Fauzi, R/o Village Sankroad, P.S. Khekara, District Bagpat and he also stated that Sir, a mistake has been done, I have “Doda-Post” with me, that is why I got scared after seeing you and that is why I was running. Then I, SI told this man that you have illegal “Doda-Post” with you then would you like to get your Jamatalashi be done before some Magistrate of Gazetted Officer, on which he stated that as I have already told you that I have “DodaPost” with me, hence there is no need to call any senior Officer and I have full confidence upon you hence you may please take my Jamatalashi. Hence, I SI prepared consent letter according to Rule 50 of NDPS and got it signed from him and did his jamatalashi, in which “Doda-Post” (Powder) recovered from a pink color polythene kept in a plastic bag hold in his right hand; and the recovered “Doda-Post” was seized and a Taraju-Baat [weight measuring equipment] was taken out from the kit and the said recovered “Doda-Post” was weighed and it was found that there are total 2.500 gram (Two & Half Kilogram) of “Doda-Post”. This failed act of the accused reveals commission of offence under Sec. 8/15 NDPS Act. He was informed about his offence and taken into police custody. 250 grams of “Doda-Post” has been taken out of the total recovered “Doda-Post” as sample and was kept in a polythene and then in a cloth and then it was stitched and then sealed with sample seal and the remaining recovered 2.250 grams of “Doda-Post” was kept in the same plastic polythene and then in the same bag, the mouth of the bag is sealed with sample seal. The people passing through the spot, were informed about the object and were asked to give evidence, but because of their personal ‘BhalaiBurai’ no public person got ready to become witness and they left from there without disclosing their names and addresses. The Memo was dictated by me SI at the spot to HCP 187 Vijender Kumar Yadav, who recorded it and after reading over it to the witnesses, their signatures were obtained on it. Sir, It is submitted that I, Dharampal Singh S/o Shri Jasondi, am resident of VPO Sankroud, PS Khekra, Distt. Baghpat (UP), Pin Code-250101, and my entire family also reside at the above address, in which my younger son Ravi, age 21 years, who is Jatav (SC) by caste and one girl namely Krishna D/o Shri Ram Niwas, resident of the same village as above, aged 21 years, who is Jaat by caste, both liked to each other and the family members of the girl conducted marriage of the girl on 10.02.2015 with some other person against the wishes of the said girl; and when on 21.4.2015 the girl came back to her village in the home of her mother, then her family members beaten her up and then on 22.4.2015 the said girl Krishna came to my son Ravi and sought his help and then both of them went somewhere else without informing anybody. And even after a great search both of them were not found. On 24.4.2015 the parents of girl Krishna and her brother Vikas and Chacha Manoj, Chacha Sudhir Rathi along with their other relatives came to my home and started saying that we are from Jaat community and this village is of Jaats and now see we will do whatever with you as we will not allow you to live in this village and we will take revenge of the girl with the girl of your family and then they started frequently visiting at my house. And now their acts have so much increased that they have now started beating the doors of my house at village at 2-3 O’clock in the night and they started giving threat to kill us and kidnap and commit rape of my daughters and kill them also and they also started saying that now we will see that who will save you and who will speak to your Chamars against our wishes, and we will not leave him also who will speak regarding us. Because of their such acts, my family members and both daughters are in a great shock and they also could not go out of the house. And they claim that we have good links at the higher levels in U.P. hence you cannot harm us in any manner and the police also cannot do anything against us. They also say that we will kill you and you cannot do anything to us in any manner and they use dirty languages regularly. On 2.5.15 at around 2.00 p.m., I received a telephonic call of my son Ravi, who was demanding some money from me as he was saying that I am running out of money and I need some money and when in the name of giving him money I asked him to meet, he gets ready to meet me and when I left from my duty and went to meet him at the place, told by him, to Qutub Minar Metro Station, New Delhi, where my Ravi and girl Krishna were already present, and I met them and caught them and made a call at No.100. A PCR Van came there and brought Ravi and that girl to Police Station Mehrauli and in the meanwhile the brother of the girl Krishna was informed at his home that their girl has been found, who is at Police Station Mehrauli. And then IO ASI Dilip Singh recorded statement of the girl according to which the girl stated that being fed up from the daily harassment and beatings of her parents and in-laws, she voluntarily went along with Ravi and she wants to live with him only; and no force has been used upon her. IO got conducted medical of the girl from AIIMS Hospital and her counseling through a NGO on 6.5.15 and handed over the girl to her family members; and Ravi was also released there itself as he was not interested in coming with me. Then the girl started living with her family in the village. And during this period also, the family members of the girl started putting pressure upon me to handover my son to them as they wanted to give him punishment personally. On 19.5.2015, the girl Krishna again ran away from her home. And then again her family members started harassing me and my family members by saying that the girl has again ran away because of you. From that day, from the family of the girl Krishna, her brother Vikash, Chacha Manoj and Sudhir Rathi started coming to my home and harassing me and stopping my way and they made me call and called me here and there and in case of my not reaching there, they manhandle me and come outside my house and give dirty abuses by saying that “ChamarGitthal” and now their activities are so much increased that they came to my house in the night and broken the doors of my house and entered inside my house and manhandled with my wife and said that now we have broken your gate only and we will not leave you also, if the boy and girl are not found to us. We informed this matter to the police on 20.05.2015 but SI Aman Singh of Police Station Khekara rather started blaming me in turn by saying that, “Jyada Bakwas Karega To Hum Tujhe Hi Ulta Band Kar Denge”, they did not hear me and ignored my complaint and they brought me to the Police Station and kept me sitting there for the whole night. On the same night at 1.30 A.M. SI Aman Singh forcibly brought me to Delhi at Shahdara in the house of my sister, from where he picked up son of my sister, Satish S/o Naresh, and one of his friend Golu from the area under P.S. Welcome and without any FIR, he brought them to P.S. Khekra, U.P. and when we informed this matter to SI Tej Bir at P.S. Welcome, he without any inquiry allowed them to go without seeing any copy of FIR or Warrant. SI Aman Singh kept those boys in the Lock-up of police station for three days without any reason and then in the evening of 23.5.15, he released those boys and then he told me that if you do not disclose the whereabouts of your son Ravi, then we will keep on picking up your family members like this. On 24.5.2015 SI Aman Singh along with brother of the girl, Chacha of the girl and some other people also came to Delhi and forcibly picked up my brother-in-law [Jija] Naresh S/o Ratan Lal from Shahdara and brought him to P.S. Khekra without any case, on which my sister Suman W/o Sh. Naresh made a call at No.100 and when she went to Police Station- Welcome, they said that no UP police personnel came to their Police station and nor they have any knowledge of this fact and they said that if the UP Police brought your husband, then go to Baghpat and made this complaint there and as such they have also ignored her complaint. The police in turn started putting pressure upon me to get my son arrested and they says that if you do not get your son arrested, we will arrest you and your elder son Sumit. SI Aman Singh of UP Police, who is from P.S. Khekra (UP) daily pick up my family members from the village and from Delhi also and kept them in the police station for many days together without any reason. me. Now, the police started harassing Till now, I was being harassed by the hands of the family members of the girl namely Manoj, Sudhir Rathi and Vikas, who were harassing me and now when I went to seek help of the police, the police also started harassing me and I am not being heard at anywhere. And atrocities are being increased upon me. That is why I have to run away from the village along with my wife and children to save our lives as because of being regularly harassed by the hands of police and inhuman behavior by some people of the village I had been totally fed up and I had been continuously kept on searching my son Ravi. On 27.5.15, I came to know that today my son Ravi has come to his Mausi Kunta at Meerut, near Medical. Then I reached at the house of Kunta along with the police of P.S. Medical, Meerut. The boy and girl were present there. We brought them to P.S. Medical. In the meantime, I informed SI Aman Singh of P.S. Khekra regarding the arrest of boy and girl to his Phone No.9410424147 from my Mobile Nos.96279465 and 8588065690. In the late night SI Aman Singh reached at P.S. Medical along with his staff and girl’s Chacha Sudhir Rathi, Manoj and brother Vikas and then at 1.15 A.M. on 28.5.15, the SI of P.S. Medical handed over boy Ravi and girl Krishna to SI Aman Singh and his staff HCP Mahender Singh and L/C Sunita Chaudhary without any Register Entry. And they brought them i.e. girl and boy, to P.S. Khekra in the morning of 28.5.15. I also accompanied them in the Car from P.S. Medical to Khekara. After reaching there what I had seen, I get shocked. The behavior of the family members of the girl was suddenly changed immediately on reaching at P.S. Khekara. Some other relatives of the girl were also present there at P.S. Khekara and they had friendly relation with the police as they were shaking hands with the police personnel present there. Now, they were giving dirty abuses to my son Ravi inside the Police Station itself and in front of the police personnel and they were also beating my son Ravi in front of the police personnel and were threatening him to kill and when the police personnel did not stop the family members of the girl, I myself started stopping them from beating my son Ravi, on which they also started manhandling me inside the police station and in front of the police staff and when I asked the police staff to stop them, the police instead of stopping them started saying wrong to me and pushed me out of the police station. And they were frankly speaking with the family members of the girl. I was not allowed to meet my son even at once and my son Ravi was under shock of beatings by the girl’s Chacha Sudhir Rathi, Manoj and brother Vikas and police. I was standing in the police station and kept on seeing all this incident. Now, I came to know that it was the pre-planning of the family members of the girl and the police. I have not made any deficiency in helping the police and legal proceeding; but now I smell some conspiracy that the police is now mixed up with the family members of the girl, and now these people can do any wrong. Under this fear, I disclosed all these things to SHO Khekra, Shri Subodh Yadav, on which he told me that we will produce girl Krishna D/o Ram Niwas before the Magistrate and whatever is the proceeding necessary, we will do. After saying this, he told me to go back and he also said that till then the boy Ravi will remain with them. But, in the evening the girl Krishna was not ready to go with her family members present there and she was saying loudly that I want to live with Ravi and I do not want to go with my family members, they will kill me and on 19.5.15 also, I left my family for saving my life. But IO/SI Aman Singh heard nothing of that girl and without her Medical and producing her before the Judge, he handed over that girl Krishna to her family members and she was not produced in the Court also. Now, my son Ravi, who was sitting inside the Police Station, the police was not telling me anything about him and they were also not allowing me to even meet with him. Now, on asking, SI Aman Singh told me that today your son Ravi will remain here and you go back and come tomorrow to bring him. I relied upon the police staff, being have faith in the protectors of law, and I left from there. On 29.5.15, in the morning when I reached at P.S. Khekra, my son Ravi was sitting there in the Police Station having a Hand-Calf in his hands; and when I asked SI Aman Singh regarding it, he told me that your son Ravi has been booked in a case. On which, I asked him that in which case, he told me that your son has been arrested while selling 2.5 Kgs. [Two and Half Kilogram] of “Doda-Post”. after hearing it. I got shocked I told him that how it can be possible when you have kept the boy and girl in the police 27/28.05.15. false case. station since the night of How you can arrest my son in a On which, he started abusing me and saying that, “Chala Jaa Warna Tujhe Bhi Band Kar Denge”. Then I helplessly remained standing there kept on seeing my son and I was forcibly pushed out of the police station and I could not do anything. And he framed this false case upon my son after taking huge money from the family members of the girl. Now, I wanted to save my son from the family members of the girl with the help of those law protectors, the same law protectors have implicated my son in the false case in connivance with them; and without any legal action, they handed over girl Krishna to her family members to kill her. And by framing a false case upon him, my son has been sent to Jail. Now, SI Aman Singh of P.S. Khekara, Bagpat, has given a totally different shape to this case as this case was relating to the love affair of a boy and girl and now by implicating recovery of 2.5 Kg. “Doda-Post” from the boy, his entire future has now been spoiled. Now, I have understand that why UP Police was harassing me because they were in connivance with the family members of the girl and because of their links upto higher level of police and politicians, the police was helping them only. In the evening of 30.05.15 girl Krishna’s Chacha Sudhir Rathi, Manoj Dhama and brother Vikas along with some other people came to my house and broke open the main gate of my house and entered inside the house and broken everything there and looted many articles from there and took them in a big cloth and they have also put their own locks on my house and took it in their possession and when my son Sumit made a telephone call from his Mobile No.9891392452 to SO Khekara, Shri Subhodh Yadav on his Phone No.09454402966 at around 7:03 P.M. and informed him about this incident of loot, he assured him to just now I enquire into the matter, and SI Aman Singh will enquire this matter. No.of NDPS Act registered at Police Station Khekada, District Bhagpat. As per the Prosecution case on S.I. Aman Singh along with staff was on law and order duty and was patrolling the school area on 28/05/2015 and was checking vehicles. While he was moving towards School from village Nurpur, which is on Delhi Saharnpur Highway Roads, he caught the applicant/accused near J.V.G Colony and on carrying out his search 2 and a half kg of poppy husk was recovered from him. The counsel for Accused argued that he is innocent and has been implicated in false and frivolous case. No contraband- poppy husk has been recovered from him. The case property which was produced, has been planted Recovery has been shown during the day time from a busy highway but no independent witness has been joined. The provision of Section 50 of NDPS Act has not been complied with. It is prayed that the accused be released on bail. District government advocate opposed the bail application. Heard both the sides, perused the case diary and police report. There is no public witness of Applicant/Accused’s arrest and recovery where as he got arrested at 4:15 p.m. The Accused stated that the alleged false recovery has been shown out of enemity. 2 and a half kgs of Poppy husk has been recovered from the Accused.
