What happened on the 26th? His friend contacted me and told 15 me that his mother, or her mother, was sick and 16 wanted to see me and the baby. 17 This I was, oh, okay. So she picked me up that morning. We got there, 18 and I went to go look for the mom. 19 them, and then he comes around the corner and tells 20 me you need to sit down. 21 need to talk to you. 22 I gave him my phone. 23 I couldn’t find You need to calm down. I Tells me to give him my phone. He, you know, tells me to sit down. I was, 24 like, no, I want to leave. I don’t want to be here. 25 He was, like, well, you need to calm down or you’re 26 going to go to jail, and then he went on telling me 27 why I had to go to jail, and told me that, basically, 4 1 if I don’t -- the lawyer told him that if I don’t 2 make him happy today with the court, the decision and 3 everything, that the lawyer would put me in jail for 4 a year. 5 THE COURT: 6 THE PLAINTIFF: 7 The lawyer will put you in jail. basically, make him happy today. 8 THE COURT: 9 THE PLAINTIFF: 10 11 12 Yes, and that I needed to, THE COURT: So you have a child together. Yes. Okay. Seven months old. And what happened prior to June 17th that made you come to court? THE PLAINTIFF: Multiple things. He’s just very 13 abusive, not physically, but mentally. 14 constantly send -- calling me names, constantly 15 shoving me around and just abusive. 16 17 18 THE COURT: He’s When you say shoving you around, that’s not physically abusive? THE PLAINTIFF: Well, it is, but I -- abuse, 19 physical abuse, I would think it as, like, punching 20 me, slapping me around. 21 22 23 THE COURT: So pushing you is not physical abuse? THE PLAINTIFF: 24 form of it, I guess. 25 THE COURT: It’s a form. Of course, it is. 26 when that happened. 27 THE PLAINTIFF: I guess it’s a So explain to me Multiple times throughout the 5 1 years that we’ve been together. 2 THE COURT: All right. 3 to court on June 17th? 4 the camel’s -- 5 THE PLAINTIFF: But what made you come What was the straw that broke Basically, my graduation from 6 high school was the 16th, and we got into an 7 argument, I guess. He took both of my graduation 8 dresses, hid them. I didn’t know where they were. 9 So his mother took me to buy another outfit for my 10 graduation. 11 The next day, I saw him and asked him why did he 12 take them. He was, like, I thought it would be 13 funny. 14 two can go to lunch with your father. 15 okay. 16 no, you’re not taking him with that attitude. 17 like, I don’t have an attitude. 18 and he was, like, well, you’re not taking him, and 19 then when I tried to take my son, he pushed my hands 20 away telling me I’m not taking him. I got mad, and then he was, like, you -- you I was, like, When I tried to take my son with me, he said, 21 THE COURT: 22 THE PLAINTIFF: 23 THE COURT: 24 regard to that? I’m, I’m just irritated, Well, who does Aaden live with? Right now, with me. Did you have any court order with 25 THE PLAINTIFF: 26 THE COURT: 27 THE PLAINTIFF: No. Okay. So -- Well, in the restraining order, 6 1 2 3 it says I get temporary custody until today. THE PLAINTIFF: I told him I’m going to take my 6 son to lunch with my father down the street to 7 Illiano’s. 8 there were multiple times. 9 10 He didn’t let me. THE COURT: So I got -- he -- What do you mean he wouldn’t let you? 11 THE PLAINTIFF: He wouldn’t let me take my son. 12 Like, he was -- the bed was -- you know, he was on 13 the bed. 14 around on the outside, and he, basically, told me I 15 can’t take my son. 16 go spend some time with my father. 17 my son and he pushed my hand away and telling me no. My son was on the inside. 18 THE COURT: 19 THE PLAINTIFF: He was wrapped I was, like, well, I want him to Okay. I went to go grab Then what happened? I called the cops and told them, 20 and they came down trying to talk some sense into 21 him. 22 then they told me -- 23 THE COURT: 24 THE PLAINTIFF: 25 26 27 When they went down there, he was gone, and And then what did you do? I went down to the court and I filed for the restraining order. THE COURT: Did you -- you didn’t take your son and go to dinner with your father? 8 1 2 THE PLAINTIFF: No, he wouldn’t let me. He physically would not let me. 3 THE COURT: Well, where was your son? 4 THE PLAINTIFF: 5 THE COURT: With him. Okay. So, so when -- so when he 6 pushed your hand away, he then took your son and went 7 away. 8 9 You didn’t tell me that part. THE PLAINTIFF: trying to take my son, he was on the bed. 10 move from the bed -- 11 THE COURT: 12 THE PLAINTIFF: 13 He did not Who’s he? -- and then I left. Tony Moreno. 14 15 He was -- he never -- when I was THE COURT: Tony was on the bed with your son. He was hold -- 16 THE PLAINTIFF: And then I tried -- I tried to 17 walk away with my son and he wouldn’t let me. 18 like, I want to take my -- 19 20 THE COURT: I was, So you tried to take your son from him? 21 THE PLAINTIFF: 22 THE COURT: 23 THE PLAINTIFF: 24 THE COURT: 25 THE PLAINTIFF: Yeah. And he wouldn’t let me. And he said no. Yeah. Okay. He’s done that multiple times. 26 If he doesn’t want me taking my son somewhere, he 27 doesn’t let me, but he’s -- 9 1 THE COURT: Okay, but that’s why you got sep -- 2 THE PLAINTIFF: 3 THE COURT: -- allowed to take him anywhere. So why are you guys still -- why 4 were you still living together? 5 living there? 6 7 THE PLAINTIFF: else to go. Why were you still ‘Cause I had at the time nowhere I was, basically, there as -- 8 THE COURT: Okay. 9 THE PLAINTIFF: Until I could find another place 10 to live, and then my sister offered her room in the 11 house to go and stay there for up to three months 12 until I can get everything situated with housing and 13 my money in order. 14 15 THE COURT: case. And you have to be in continuous 18 threat of present physical pain, physical injury, 19 stalking, or a pattern of threatening. 20 a custody dispute, a visitation dispute. 21 afraid he’s going to come over and beat you up? 22 THE PLAINTIFF: Sometimes. You two have Are you I’ve had multiple 23 times where cars just stop in the front of the house, 24 and multiple times where I feel like he’s -- I feel 25 like he’s always there, and it’s creepy. 26 where my sister was when I didn’t even know where my 27 sister was. He, he knew He texted me and told me, you know, are 10 1 you on Newfield? 2 like, I, I -- I was home. 3 knew my sister was on Newfield. 4 5 6 7 THE COURT: My -- with your sister, and I was, When did he kick you out of bed when you had a fractured ankle? THE PLAINTIFF: THE COURT: 9 THE PLAINTIFF: It was a few months ago. I Give me a ballpark. 10 THE COURT: 11 THE PLAINTIFF: 13 How long was that? don’t know the exact date. 8 12 So I don’t know how he Um -- Before or after the baby was born? After, way after. My son was about six months old when that happened. THE COURT: You said he would hurt your child. 14 You said that you fear for your child’s safety. 15 could hurt my child. 16 if he’s making too much noise. 17 watch him if he does not feel up to it. 18 son on the bed upstairs to cry and completely left 19 the house. 20 He has told my child to shut up He told his mom to He left my When did that happen? THE PLAINTIFF: I don’t know the exact date. 21 believe it was sometime in -- it was, it was 22 somewhere around the -- April or May. 23 around there. 24 THE COURT: 25 son is. 26 know your -- 27 He I Somewhere You say you don’t know where your You know where he is -- you said you didn’t THE PLAINTIFF: At the time, I didn’t know where 11 1 my son was when I wrote this. 2 THE COURT: 3 THE PLAINTIFF: 4 THE COURT: 5 THE DEFENDANT: 6 THE COURT: 7 10 13 What’s your side of the story? Starting from which point? I guess, I guess from when the baby THE DEFENDANT: Okay. It was starting the day that she went and got the -- is it a restraining order or a protection order? 11 12 Yeah, but I didn’t know where. was born. 8 9 He was with his father; right? THE COURT: She got a restraining order on June 17th. THE DEFENDANT: Okay. So that day, we had 14 been -- we stopped at her dad’s house. 15 something to go do, so he wanted to go to lunch with 16 us later. 17 wasn’t being very pleasant. 18 I was, like, if you’re going to keep being like this, 19 I was, I’m not going anywhere with you. 20 your dad it’s going to be just you. 21 she thought just you meant her and the baby. 22 So we agreed. He had We were walking. She I was -- so I told her, You can tell For some reason, So we walked around for ten/fifteen minutes 23 longer, went back to my mom’s house. I took the baby 24 upstairs, sat upstairs for about twenty minutes, and 25 she didn’t come inside. 26 if she would bring the baby back up. 27 why would I bring him up if we’re leaving? So I texted her, asked her She’s, like, I was, 12 1 like, no. 2 with you when you’re being like this. 3 like, he’s coming with me. 4 you’re being like this. 5 I said you can go. I don’t want him going So then she’s, I was, like, not when Then she came upstairs and started getting 6 louder and referencing, I’m taking my son, and I was, 7 like, if you’re going to keep being like that, I 8 don’t want him going with you, and then she walked 9 out. So I texted her. 10 yet? She said she didn’t want to talk to me, so, all 11 right. 12 I was, like, are you calm Fine. Then she came up. Came storming in the room and 13 tried to take him. 14 was, like, you need to relax before you take him. 15 She was, like, no, give me my bleeping son. 16 like, not when you’re being like this and stuff. 17 She got mad. So I put my hand in the way. I I was, Took the necklace I bought, the 18 ring, and a couple of bracelets off, threw them down 19 next to where I was and then stormed out. 20 come back upstairs for about ten/fifteen minutes. 21 then, apparently, she had left. 22 So then, my mom left. Didn’t So So I went downstairs. 23 Nobody was there. 24 walking around the block assuming she went to lunch. 25 So I walked down to Illiano’s. 26 So I didn’t know where she was. 27 So I took the baby and started They weren’t there. So I then started walking back towards my house. 13 1 I ran into my cousin. Well, not by blood, but we 2 grew up together. 3 was, oh, you know, my mom wants to see the baby. 4 Whatever, whatever. 5 my house, my phone fell down the stairs so my screen 6 was destroyed. 7 there was no way I could have used it. 8 to touch it, but it was doing its own thing. 9 phone was broken. So I was talking to her, and she And, oh, previous to me leaving So I did shut my phone off because I was trying So I turned it off. 10 So I went with her -- 11 THE COURT: 12 THE DEFENDANT: Did you get a new phone since then? Yes. So I went with her to -- 13 then we went to her mom’s house. 14 for -- I was there for, maximum, two hours. 15 16 THE COURT: landline? THE DEFENDANT: 18 THE COURT: 20 21 We were hanging out They have a phone on -- they have a 17 19 My Yeah. Do they have a -- somebody else in the house have a cell phone? THE DEFENDANT: Yeah. They had a phone. So when I was -- 22 THE COURT: So why -- why didn’t you call? 23 THE DEFENDANT: I assumed she was mad and just 24 walking and stuff, and there was plenty of ways for 25 her to contact me. 26 THE COURT: How? 27 THE DEFENDANT: She didn’t try any of them. 14 1 THE COURT: 2 THE DEFENDANT: 3 She didn’t know where you were. My mom -- she -- 4 THE COURT: 5 THE DEFENDANT: 6 She could have contacted my mom. Your mom didn’t know where you --- knows everybody I normally hang out with. 7 THE COURT: 8 THE DEFENDANT: 9 THE COURT: 10 Your mom didn’t know where you were. But everybody -- No one knew where you were. THE DEFENDANT: Everybody can reach out and 11 somebody will tell you where I am. 12 always find me. 13 Everybody can It’s not hard. But, so somebody had sent my cousin a 14 screenshot, a picture of what they saw on Facebook, 15 and oh, did you know Tony’s baby is on Facebook? 16 They’re saying he stole him. 17 gone for two hours. 18 me. 19 time did they refer to me as his father. 20 this man. 21 saying, oh, Middletown Police can’t do anything for 22 twenty-four hours. 23 24 25 This was after me being So then there was a picture of Oh, if you see him with this man -- no point in It was just You know, and then they were going on THE COURT: As soon as we saw that -- We have a paternity acknowledgment signed at the hospital? THE DEFENDANT: Yeah. So as soon as we saw 26 that, I called my mom. I was, like, what’s going on? 27 She’s like, the cops just left. Apparently, she went 15 1 and got a restraining order because she was mad. 2 This and that. 3 I was okay. 4 up. So you have to bring the baby back. Well, this is where I am. Come pick me 5 So as soon as she came to pick me up, we went to 6 the Ninety-Nine in Cromwell because my brother was in 7 the car. 8 were talking. 9 ten/fifteen minutes talking -- I was trying to figure 10 So, you know, I -- the whole way there, we We sat in the parking lot for about out what was going on. 11 THE COURT: Who’s we? 12 THE DEFENDANT: 13 THE COURT: 14 THE DEFENDANT: Me and my mom. Yeah. And then, she said, you know, 15 base -- like, she showed me the papers that had got 16 dropped off at the house. 17 was, like, basically, you know, we have to bring the 18 baby. 19 the baby, you know, to the police station or wherever 20 she went. 21 Me and my brother went inside. 22 baby. 23 So I read them, and she You know, you don’t have to come. I can bring I’m not sure where she went after that. She left with the That was about it. And as far as me violating the protection order 24 on Friday, I wasn’t in town on Friday. 25 sure how I did that. 26 THE COURT: 27 THE DEFENDANT: So I’m not Where were you on Friday? I was at my sister’s house in 16 1 New Britain. So -- 2 THE COURT: All day? 3 THE DEFENDANT: 4 THE COURT: 5 THE DEFENDANT: 6 THE COURT: 7 THE DEFENDANT: 8 THE COURT: 9 THE DEFENDANT: Yeah. How did you get there? I got dropped off by a friend. Who? Alyssa Rodriguez [phonetic]. So -The same person she got in the 10 car with. I believe it was a day previous and stuff. 11 She had been with this person. 12 Britain. 13 THE COURT: 14 THE DEFENDANT: Friday, I was in New From what time to what time? From around 8:30 in the morning 15 until about 10:00 o’clock at night, and I have people 16 that can verify that. 17 THE COURT: 18 I never left her house. She says you pushed her off the bed. Did you push her or shove her? 19 THE DEFENDANT: So that particular night and 20 stuff, we had -- we weren’t exactly arguing, but 21 she -- she throws temper tantrums, so I was ignoring 22 her. 23 sitting on the inside of the bed with the baby, and 24 she kept pushing my legs aggressively. 25 kept straightening them back out and putting them 26 back on the bed. 27 of the bed, and I, you know, didn’t want to argue So I had headphones in, and she had been So I just She kept pushing them off the side 17 1 with her. I just kept putting my legs back. The 2 last -- after doing it, like, six times, the last 3 time I straightened out my legs, she happened to be 4 sitting there, and I kicked her off the bed, and I 5 asked her, are you okay? 6 fractured ankle, then got up and started kicking 7 things around the room and throwing stuff like a 8 three-year old. 9 with a fractured ankle. She then -- now, with her So I’m not sure how that works out 10 THE COURT: 11 THE DEFENDANT: 12 THE COURT: 13 THE DEFENDANT: I assume that would hurt. Do you have a job? Yes. What do you do? I work for my uncle doing -- 14 he’s a general contractor. 15 technically, my title would be a laborer. 16 basically, do whatever is -- 17 THE COURT: 18 THE DEFENDANT: So I’m -- I think, So I, Did you graduate high school? Yeah. Well, not high school. 19 went and got my GED shortly after leaving high 20 school. 21 THE COURT: 22 THE DEFENDANT: 23 THE COURT: 24 25 I So you got your GED? Yeah. So you two don’t have a real good relationship. THE DEFENDANT: We did, but when she gets angry 26 and stuff, she -- that’s it. She’s just -- whenever 27 she doesn’t get her way, she throws temper tantrums 18 1 because that’s not the first time she’s sat there 2 throwing stuff around. 3 with us, and stuff, can tell you over the past year, 4 she always has fits. 5 give her her way. 6 THE COURT: 7 THE PLAINTIFF: 8 9 10 THE COURT: And you can’t live with either one of them? 12 THE COURT: 13 THE PLAINTIFF: 16 THE PLAINTIFF: 17 THE COURT: And where does your sister live? place? THE PLAINTIFF: 20 THE COURT: 21 THE PLAINTIFF: 25 1185 Randolph Road. And was -- well, how big is her 19 24 My mother has a one bedroom and my father has a one bedroom. THE COURT: 23 No. How come? 15 22 My mom, she lives in Waterbury, and my father lives in Middletown, South Main Street. THE PLAINTIFF: 18 She gets mad whenever I don’t So where do your folks live? 11 14 There -- the people who live I’m sorry. What? How big is her place? It’s a three-bedroom, I believe. Three bedroom. THE COURT: And who lives there besides the two of you? THE PLAINTIFF: Her husband, her son, my sister. 26 Those are the only people that live there. 27 sisters, my brother-in-law, and my nephew. So my two 19 1 THE COURT: So a big, big crowd of people. I’m 2 just not convinced that there’s a continuous threat 3 of present physical pain or physical injury. 4 I think the two of you don’t have a good 5 relationship, and you need to get -- somebody needs 6 to go downstairs and file a custody application, and 7 you need to work out a parental rights agreement 8 where the child is going to be, when the child is 9 going to be with mom, when the child is going to be 10 with dad, work out a child support order. 11 working, you know, get a child support order. 12 child on HUSKY? 13 THE PLAINTIFF: 14 THE COURT: If he’s Is the Yeah. So the child is on HUSKY. So, I 15 mean, you know -- so there’s health insurance, but 16 you need to work out -- you need to -- you know, 17 there’s chaos in your relationship. 18 satisfied that this -- that he’s -- that you’re in 19 imminent fear, in imminent harm that he’s going to 20 come over and, you know, cause you physical harm or 21 physical violence. I’m not 22 I’m just not convinced that that’s going to 23 happen particularly if you’re not living together any 24 more, and it sounds like you’re not living together 25 any more, but you do need to work out a parenting 26 plan where you know when the baby is going to be with 27 mommy and when the baby is going to be with daddy, 20 1 and you go downstairs to the Clerk’s Office and do 2 that. 3 application. 4 can waive the filing fee. 5 fees paid for by the State, and you can serve him 6 with the papers, and then you can just work out a -- 7 work that out, but it sounds to me as though your 8 relationship, unfortunately, is over, and your child 9 is going to grow up with a mom living in one house File the paperwork. It’s a custody If you’re -- if you have no income, you You can have the Marshal’s 10 and a dad living in another house. 11 as though that’s what’s going to happen, I mean, 12 because it’s unfortunate, but you don’t -- it doesn’t 13 sound to me as though that this is a relationship 14 that would -- that’s healthy to have a child grow up 15 in. 16 It sounds to me I don’t know whether the two of you are mature 17 enough at this present time to have an adult 18 relationship. 19 of you talked to me about is behavior that, you 20 know, teenagers -- you know, you’re 21, but, you 21 know, you’re talking -- you’re not giving me grown-up 22 behavior. 23 24 You know, the behavior that both You’re giving me child -- you know, so. So in any event, the restraining order -- I guess this is something I need to sign; right? 25 THE CLERK: Yes, Your Honor. 26 THE COURT: I’m not going to -- so I’m not going 27 to grant the restraining order.
