Hyman Sole Member-Manager 37 Forest Drive Voorheesville, New York 12186 July 6, 2015 Mr. Robert Williams Executive Director NYS Gaming Commission One Broadway Center Schenectady, New York 12305 Dear Mr. Williams: It is with profound regret that I must inform you and the members of the Gaming Commission that Hyman Hemispheric, LLC (d/b/a Southern Tier Star Casino & Conference Center) will not be submitting a proposal in response to the Commission’s March 23, 2015 RFA for a Region 5 gaming facility license. Our team has worked tirelessly over the past several months – indeed since March 23rd – to create a project that would deliver a superior gaming and hospitality experience to its patrons and be a source of great pride and prosperity to the City of Binghamton and the true Southern Tier Region. We acquired the rights to the premier location. We received the unanimous support of the Binghamton City Council. We completed all studies and exhibits required for the bid proposal. We even arranged for equity financing that would have made our proposal the unqualified winner of the gaming facility license for Region 5. Unfortunately, the release of new EnZone boundary maps, which appear to exclude our site from its prior EnZone designation, has dealt our project a fatal blow. The key to making a project of the scale and quality required by the RFA viable in the Southern Tier is the ability to fully participate in the State’s Brownfield Program – particularly the EnZone program. Our equity partners required the benefits of the EnZone designation in order to participate in the project. The effect of the new EnZone boundary maps is that our Project Site was included in an EnZone area on June 30th, and excluded on July 1st. Given this devastating turn of events, our equity partners had no choice but to withdraw from the project. Moreover, given the late date of their decision (July 4th) and hindered further by the bid being due the day after a holiday weekend, we were left with no choice but to abandon our project. Regretfully. We have informed the City of Binghamton and the County of Broome of our inability to proceed with a bid for our project. As you can imagine, their disappointment is overwhelming. For the Southern Tier Region, the difference of our project being included within an EnZone on June 30th – and NOT included on July 1st, is the difference between over 1,100 full time union construction jobs for a 24 month period, and over 700 permanent full-time union jobs thereafter, versus no new jobs within the City of Binghamton what-so-ever. Our projected overall direct and indirect revenue impact, locally and for the State, would have been seismic. We share their disappointment over this development, and we will continue our commitment to the City of Binghamton to develop our project site as an alternate mixed-use development. Regretfully, no alternate project will be able to deliver the transformational economic benefits that our Southern Tier Star Casino & Conference Center project would have provided. Nevertheless, on behalf of Hyman Hemispheric, LLC, and the entire team of professionals who have been laboring for months to make our vision for the City of Binghamton a reality, I thank the Commission for the opportunity to participate in the RFA process, and I wish the remaining competitors for the Southern Tier casino license the very best – because the entire Southern Tier Region is now relying upon them to deliver the type of transformational development that Hyman Hemispheric, LLC would have delivered, had circumstances been different.
