DECLARATION OF DISASTER PROCLAMATION AND MANDATORY EVACUATION ORDER WHEREAS, the City of Grapevine, Texas on the 17 day of June, 2015 has suffered widespread or severe damage, injury, or loss of life or property (or there is imminent threat of same) resulting from excessive rainfall and the flooding of Grapevine Lake and the Benton Creek area; and WHEREAS, the Mayor of Grapevine has determined that extraordinary measures must be taken to alleviate the suffering of people and to protect or rehabilitate property; and WHEREAS, the Mayor of Grapevine has the authority under 418.185 of the Texas Government Code, to evacuate an area stricken or threatened by a disaster and may compel persons to leave and use reasonable force to remove persons from the area; and WHEREAS, 418.185 of the Texas Government Code creates liability for persons refusing to comply with this Order and relives and officer or employee of the City of Grapevine from liability NOW, THEREFORE, BE IT PROCLAIMED BY THE MAYOR OF THE CITY OF GRAPEVINE: 1. That a local state of disaster is hereby declared for the preservation of life pursuant to 418.108(a) of the Texas Government Code. 2. Pursuant to 418.018(b) of the Texas Government Code, the state of disaster shall continue for a period of not more than seven days from the date of this declaration unless continued or renewed by the City Council of Grapevine. 3. Pursuant to 418.018(c) of the Texas Government Code this declaration of a local state of disaster shall be given prompt and general publicity and shall be filed with the City Secretary 4. Pursuant to 418.018(d) of the Texas Government Code, this declaration of a local state of disaster activates the City emergency management plan. 5. Pursuant to 418.185(e) of the Texas Government Code, City employees and officers are authorized to use reasonable force to remove persons form the area and are immune from liability for their actions under this evacuation order. 6. Pursuant to 418.185(d) of the Texas Government Code, any person who remains in the area may be civilly liable to the City. 7.
