County, Montana, the Defendant committed the offenses of Theft, two counts, both felonies, in violation. of Mont. Code Ann. or in the alternative, False Claims to Governmental Agencies, two counts, in violation of Mont. Code Ann. 45?7?210. The facts ?constituting the offenses follow. COUNT I On or between January 1, 1997, and April 30, 1998, in Lincoln County, Montana, the Defendant, Larry Dolezal, did I NFORMI-LTI ON PAGE 1 JJ purposely or knowingly and as part of a common scheme, obtain 80% by deception control over property, namely money of Lincoln County, by filing claims of meal reimbursements to which he was not entitled and he had the purpose to deprive Lincoln County of its property. The value of the property exceeded $500. COUNT II In the alternative to the offense alleged in Count I, on or between January 1, 1997, and April 31, 1998, in Lincoln County, Montana, the Defendant, Larry Dolezal, did purposely or knowingly and as ea part of a common scheme, presented for payment false or fraudulent claims for meals reimbursement to which he was not entitled, to a public agency, namely, Lincoln County. The value of the claims exceeded $500. COUNT On or between January 1, 1997, and April 30, 1998, in Lincoln County, Montana, the Defendant, Larry Dolezal, did purposely or knowingly and as part of a common scheme, obtain by deception control over property, namely money of Lincoln County, by filing claims of mileage reimbursements to which he was not entitled and he had the purpose to deprive Lincoln County of its property. The value of the property exceeded $500. I 0N PAGE 2 500K COUNT IV In the alternative to the offense alleged in Count on 1997, in Lincoln or between January 1, and April 30, 1998, ?County, Montana, the Defendant, Larry Dolezal, did purposely or knowingly and as a part of a common scheme, present for payment false or fraudulent claims for mileage reimbursement to which he was not entitled, to 51 public agency, namely, Lincoln County. The value of the claims exceeded $500. A person convicted of the offenses alleged in Counts I and shall be imprisoned in the state prison for a term of not more than ten years or be fined an amount not more than $50,000, or both. A person convicted of the offenses alleged in Counts II and IV shall be imprisoned in the state prison for a term of not more than ten years or be fined an amount not more than $10,000, or both.
