Dear Sir, Thank you for your letter No. 788 dated 05-06-2015 regarding starting of video-recording of the proceedings of Court No. 24, intimating me that same is under process and this registry if actively pursuing with the matter for completion of the same in time. A copy of your letter is attached for the ease of reference. Your letter dated 05-06-2015 was in response to my letter of 03-06-2015, in which I had stated, inter alia, as under "As the hearing of these matters is from ju'ne 17th onwards, please confirm that you have made arrangements for starting video~ recording the hearings from june 1 7th, 2015 onwards. Please appreciate that I have to come from Delhi for the hearings, and I have no intention of coming to Kolkata only to learn that your omce has not carried out the instruction issued to it in open Court on 14-05? 2015, and that?consequently, there will be no video?recording of court proceedings. -1- As you will kindly appreciate, as per observations of Hon'ble Mr. Iustico Anirudha Bose prior to the vacations, he has directed that while CP No. 33 of 1988 and No. 90 of 1983 shall be on the Cause List [June 2015), the hearings shall start from Wednesday, lune 17th 2015, after His Lordship returns from the tour to the Andamans Circuit Bench. You will further appreciate that this would mean that I must arrive in Kolkata by the morning of Tuesday, June 16th, 2015 so as to prepare the papers for the hearing. This further means that in order to take advantage of concessional fares, I must book my air ticket at least day in advance (Le. by today evening), failing which I shall be burdened with extra costs. Under these circumstances, I shall be most grateful if you would kindly confirm to me by evening of today that the arrangements stand completed, and that the hearings shall be video-recorded. This Confirmation is most important because in absence of that confirmation, and in view of the open threat of physical assault delivered to me most menacingly by 6 advocates of Khaitan 8: Company during the last hearing, I am not willing to visit Kolkata for the court hearings. As you will kindly appreciate, I have to protect my life body from physical to me, as well as to my personal dignity that is harmed by the constant barrage of heckling, taunts and abuses that are delivered to me by advocates of the other side. This can only be prevented if there is prior knowledge of all the parties concerned that there shall be incontrovertible and undeniable evidence of their conduct in court. Therefore, as one TO??icer of the Court' to another, kindly extend me the courtesy of a formal confirmation in return reply. Yours faithfully, DEEPAK Encl. Your letter dated 03-06-2015. Registrar [Original Side] Hon?ble High Court of Calcutta KOLKATA May 14th, 2015 SUB ECT VIDEO-RECORDING 0F COURT PROCEEDINGS. Dear Sir, Owing, inter alia, to the unending heckling and abusive verbal assault being indulged in repeatedly by advocates from the other side during hearings (including the use of ugly, not to mention wholly-inaccurate, words like 'j/ou are garbage", "you are a jackass", etc), in View of the situation having reached a ?ash- point today where there almost was a physical scuf?e between Senior Advocate Ratnanko Banerjee and the undersigned in the Court itself [because he used the word "jackass", but not in relation to himself), the Hon'ble Court summoned the Registrar and the It. Registrar (Mr. Kundu] and passed a direction to them today in open court to take the Ld. Presiding Officer's administrative approval immediately, so that proceedings from the next date onwards would be video? recorded. In light of this development today, you are requested to kindly take requisite approvals expeditiously, and confirm to the undersigned in writing that the proceedings thereafter will be video-recorded, failing which we respectfully refuse to appear, as it only results in a embarrassingly-public erosion of our much-valued dignity, as well as diminution of the standing and authority of the Hon'ble Court and the solemnity of the proceedings it conducts, not to mention forcing us to be subjected to the distinct possibility of brutal physical assault as well. Yours faithfully, DEEPAK KHOSLA
