HAYDEN has been the MSU women's softball team manager for the last two years and a senior at the college. The initial interview on 5/4/15 was recorded-a copy of this recording will be attached to this case file. HAYDEN stated he was traveling on the team bus to the Central Michigan University softball game on Wednesday4/29/15. He believed they boarded the bus at 12:45 PM in Lansing. He stated he was sitting in the third row of seats behind coach JESSICA BOGRAKOS and JACQUELINE JOSEPH. He added that those two coaches were seated in the front row. He told me that there was another assistant coach ANDREA HARRISON seated in the second row along with assistant coach JT GASSOW. He told me he estimated the distance between the coaches (BOGRAK.OS & JOSEPH) and himself as 5 to 7 feet. HAYDEN went on to say he was minding his own business looking at twitter on his phone when he overheard the two coaches (BOGRAKOS and JOSEPH) talking about structuring scholarships for the next season. He explained this conversation interested in him so he began listening. HAYDEN told me that the conversation shifted from the structuring of scholarships and recruiting to how parents get angry when scholarship awards are decreased. Next, he heard JOSEPH and BOGRAKOS talk about retaliation and that there were certain things that a head coach could or couldn't do. He then heard BOGRAK.OS say "so I should just hit her then" and JOSEPH responded yes. JOSEPH went on to say you can hit her and I can say it was an accident but if I hit her they can pin retaliation on me. At this point BOGRAK.OS stated to JOSEPH "then I can hit her" and JOSEPH responded yes. HAYDEN told me he was not sure who they were talking about when this conversation took place between the two coaches. HAYDEN told me when he got off of the bus he was setting up a camera and computer prior to the game in centerfield at CMU. He said the other team manager, AUSTIN KRUS, . was helping him. As they were talking HAYDEN told him (KRUS) about the conversation he overheard on the bus. He asked KRUS if he could see something like that happening (hitting a player with a pitch) to which KRUS replied that he didn't know but it would be horrible if something like that happened. The text from McBRIDE stated that coach BOGRAK.OS hit her on purpose while she (BOGRAKOS) was pitching. He told me that McBRIDE also said that DANI (DANIELLE GORANSON) also witnessed it. After he received the texts he told me he was in shock and couldn't believe it. Upon receiving the text regarding the coach hitting her he motioned to KRUS (who was sitting next to him) to take offhis headphones. He let KRUS read the text and he (KRUS) just shook his head. HAYDEN explained that they were sitting near the coaches so he didn't want to say it out loud. In my second interview with HAYDEN I asked him to complete a seating sketch of the bus where each of the individuals were seated (See attached Appendix A). He completed the sketch and initialed the seats in which the coaches and assistant manager were located. HAYDEN explained that he wished he never heard this conversation because of the opportunity he was afforded by working as an MSU team manager. HAYDEN stated the coaches were always good to him and helped him out. He went on to say what he told me was the truth and that what had occurred (throwing at a player) was not right. INJURIES: 1. Right upper wrist area from softball pitch on 4/29/15. 2. Left upper wrist area from softball pitch on 5/3115. PHOTOGRAPHS: I personally photographed the injuries to McBRIDE's arms on 5/4115. The photographs will be attached to this case file and an additional copies forwarded to MSP's central repository. MEDICAL RECORDS: I obtained medical reports for ALYSSA McBRIDE on 5/7/15. McBRIDE was examined by Dr. Robert Schaefer MD on 5/4/15 at Orthopedic Associates in Portage, Michigan. She was assessed as having a soft tissue contusion and bone contusion of the ulna-left foreann. An x-ray was taken of the injured area and did not reveal a fracture. Her treatment plan was that of ice, rest, NSAIDS and follow-up as needed. Ifher pain persisted she was to obtain a follow-up x-ray to make sure there was not an occult fracture. STATISTICS-JESSICA BOGRAKOS BOGRAKOS was a two-time NFCA All-America honoree at Michigan State University while playing on the women's softball team. She was a pitcher who holds the MSU record for career no-hitters (4), wins (72), shutouts (24) and strikeouts (659). She also holds the single-season records for wins (29), innings pitched (283.1), appearances (53), shutouts (13) and the top two spots on the single-season strikeout chart (264, 235). ZALEWSKI returned my phone call from a previous voicemail that I had left for her regarding this investigation. ZALEWSKI has been a member of the Michigan State University Softball Team for two years and currently plays the position of pitcher. She does not participate in batting practice but picks up balls for the coaches when they are pitching at practice. ZALEWSKI told me she has only heard of three or four players ever being hit by a pitch during batting practice that was thrown by Coach JESSICA BOGRAKOS. She went on to say one of the players was JACKIE RISER and the other two were MCKENZIE LONG and ALYSSA MCBRIDE. She told me the only two she personally witnessed being hit were LONG and MCBRIDE. ZALEWSKI stated she was sitting near the batting cages prior to the game against Central Michigan University on 4/29/15. She said while she was watching batting practice LONG was_the first batter and she thought she may have been hit by a pitch (thrown by BOGRAKOS) but was not sure. She went on to say when ALYSSA MCBRIDE took her tum during batting practice BOGRAKOS threw a pitch directly at her head which struck her in the arm area. When asked she did not know if the pitch was thrown intentionally or not. ZALEWSKI advised on 5/3/15 she was in the outfield during batting practice prior to their game against Maryland. She added that the game took place at Michigan State University. She told me that BOGRAK.OS was pitching to the players and when MCBRIDE got up to bat BOGRAKOS threw a pitch directly at her head. She stated she could see this pitch was thrown much faster than any other pitch that was thrown by BOGRAK.OS that day. ZALEWSKI went on to say after the pitch struck MCBRIDE she discussed it with DANI GORANSON as they were in the outfield together. She told me she felt it was odd that MCBRIDE was hit with a pitch two times in one week. She added that BOGRAKOS is an accurate pitcher. INTERVIEW DANIELLE GORANSON I interviewed DANIELLE (DANI) GORANSON on Thursday 5/14/15 at 12:15 PM via TX. GORANSON contacted me at my office after I had left her a previous voicemail regarding investigative follow-up. GORANSON has been a member of the Michigan State University softball team for the past four years but did not practice as a sophomore. GORANSON stated she has participated in batting practice for three seasons and also plays the position of pitcher. She told me during this time she has never been hit by a pitch thrown from Coach JESSICA BOGRAKOS. When asked GORANSON told me she has only heard of two players ever being hit by a pitch thrown by BOGRAKOS in batting practice. She said the two players that were hit by a pitch were ALYSSA MCBRIDE and MCKENZIE LONG. GORANSON advised she was sitting next to the cage prior to the Central Michigan University game on 4/29/15. GORANSON said she was in the outfield while the team was taking batting practice on 5/3/15 prior to the Maryland game at Michigan State University. She stated BOGRAK.OS was pitching and when ALYSSA MCBRIDE was taking batting practice she threw a pitch directly at her (MCBRIDE'S) head. She told me she thought it was strange that MCBRIDE was once again hit with a pitch thrown by BOGRAKOS within such a short period of time. GORANSON told me her mom and dad were present during batting practice on this date (5/3/15). She advised their names are JIM and WENDY GORANSON. INTERVIEW SYDNEY HEATH: I interviewed SYDNEY HEATH on Wednesday 5/27/15 at 10:30 AM after she contacted me via TX. A previous voicemail was left with HEATH asking her to contact us regarding this investigation. HEATH has been a member of the Michigan State University softball team for one year and played the position of outfielder. She is on a partial scholarship for softball at the university and she just finished her freshman year. HEATH told me that coach BOGRAKOS has thrown batting practice to her numerous times throughout the season and has never come close to striking her with a pitch. She advised she bats left-handed and stated that BOGRAKOS is a very good pitcher. He told me she was present at the Central Michigan University softball game on 4/29/15. She added she was stretching behind the individuals on the team taking batting practice at the cage in the CMU facility. HEATH stated the only person she saw that was hit with a pitch thrown by BOGRAKOS was ALYSSA MCBRIDE. She advised the pitch was thrown directly at MCBRIDE'S head but she was able to get out of the way causing the pitch to strike her in the forearm area. After it occurred she heard BOGRAKOS say she was sorry but didn't hear MCBRIDE say anything. She felt that BOGRAKOS threw the pitch at MCBRIDE intentionally based on the trajectory and how it was thrown. I asked HEATH if she overheard any type of conversation on the bus regarding a player being intentionally hit by any of the coaching staff to which responded no. She told me she was seated in the back of the bus and couldn't hear any of the conversations that were going on at the front of it (bus). HEATH told me that MCBRIDE was one of the players that the coaches did not treat well as she was not one of their favorites. Christensen and I drove to Michigan State University on 5/13/15 to interview coach Jessica Bograkos and coach Jacqueline Joseph. When we arrived at the Jenison Field House on the MSU campus, Bograkos was observed leaving the parking lot in her vehicle. We were able to contact Bograkos on campus at a stop light and asked if we could interview her. The interview took place in D/F!Lt. Christensen's vehicle at approximately 2:55 p.m. in a parking lot on the MSU campus. She was also advised that we just wanted to ask her some questions. Bograkos was asked how long she had been coaching and if she was employed by MSU. She stated she has coached for 7 years and was employed by MSU. She also stated that she had played softball at ~SU as a student. It was explained that McBride had filed a report in reference to getting hit two times during batting practice. Bograkos was also told that we were aware of the conversation she had on the bus about retaliation and hitting a player. She was also informed that we were aware that she (Bograkos) had made the statement to Joseph "so you want me to hit her" and Joseph said "yes." Bograkos was told it was our understanding that she had again asked Joseph if she wanted her to hit her, and again the response from Joseph was yes. Bograkos was asked why they were going to hit McBride and Bograkos responded that that conversation never occurred on the bus. Bograkos stated there was never a conversation where she was asked to retaliate against McBride. She stated she is 100% sure that she never had a conversation like that with Joseph or anybody else. Bograkos also stated that she has hit everybody on the team at least once or twice this year. She stated she was not that accurate with her pitching. She again stated that she has never had a conversation about hitting anybody with a softball. Bograkos was asked if Joseph ever made the comment "if they come to me I can say it was an accident." Bograk:os stated no, that's not how we work here. Bograkos did state that there has been issues with McBride's parents in the past and during the previous season they had even talked about having her father banned from the games because he is very intimidating. Bograkos also stated that she had hit another player the same day that she hit McBride. Bograk:os stated she hit McKenzie Long in the head that day and hit another player, Jackie Reiser, in the leg. She stated at Central Michigan University they were practicing rise balls, which is a difficult pitch for her to throw, and the last game of the season at MSU they were practicing inside pitches during batting practice. Bograk:os was asked how many players she thinks she has hit and she stated over the years she has hit hundreds of players. She also stated that in the previous year she had hit a player, Kelly Confer, in the face with a pitch that had bounced off of Confer's bat. Bograk:os stated that Confer had to have her jaw wired after getting a tip ball in the face, which bothered Bograkos for some time. Bograk:os was also asked if there was any possibility of a conversation she had with Joseph on a bus being misunderstood, where someone may think she was talking about hitting a person during batting practice or retaliation against a player. Bograkos stated she had a conversation with Andrea Harrison about Alyssa's comments to a reporter, but did not believe she spoke to Jackie Joseph at all on the bus about McBride. Bograk:os was also asked if there was any conversation about restructuring scholarships and she stated she does not remember any conversation about that on the bus and does not believe that conversation occurred. During batting practice Bograkos stated she usually stands 30'-35' from the plate when she pitches, with a normal pitcher's mound being 43' from the plate. Bograk:os was asked if Jackie Joseph was currently at the college and if she thought it would be alright for officers to talk to her there. It was explained that we did not want to disrupt anything at the college. Bograkos stated that the last time she knew, Joseph was in her office and there should not be any problem with officers making contact with her there. The interview with Bograkos then ended. Gutnecht stated they have other coaches that pitch what they call front toss, which is just tossing the ball in for batting practice, however Coach Bograkos will do the full wind up for batting practice. Gutnecht stated she has been hit during batting practice one or two times during the two years she has been playing at ~SU and stated that she bats right handed. During the game at Central Michigan University she stated that she was not hit during batting practice and did not remember anyone being hit, although she was not sure. It should be noted that McBride was in Gutnecht's batting practice group at CMU and was hit during batting practice. Gutnecht stated that during the last game of the season at MSU she was almost hit by a pitch in batting practice because they were working on inside pitching. She stated that McBride was hit on the wrist with a high and inside pitch during that batting practice. Gutnecht also believes that Jackie Reiser may also have been hit on the last day of the season. Gutnecht stated she did not see anything unusual with the pitch that hit McBride. Stoffer also did not see anyone get hit while taking batting practice. Stoffer stated they break up into groups for batting practice and if their group is not participating in batting practice they are somewhere else on the field, so she may not be aware of someone else being hit. Thomas stated regarding the last game of the season she does believe one of the players got hit, who was a left handed hitter, and she believed it may have been McKenzie Freimuth, however she was not sure. I tried to narrow her down to the number of times, however she was not sure and would only say it was a handful of times. She did take batting practice at Central Michigan University and was not hit, and stated that during the last game of the season at MSU she was not hit and was not aware of anyone else being hit. When asked about how many times she had been hit during her five years of playing, she stated many times and that it does happen, depending on what kind of pitches you are practicing. Sanders also stated that during the last game at MSU she did not see anyone get hit during batting practice in her group and she was also not hit. Sanders stated she thinks Coach Bograkos does a good job. KRUS advised that prior to the Central Michigan University game (4/29/15) he and HAYDEN were either getting off the bus or out in the field setting up when HAYDEN told him he overhead Coach JESSICA BOGRAKOS and JACQUELINE JOSEPH talking about hitting someone with a ball in batting practice. He was shocked by the conversation and believed it was a stupid thing to do. KRUS stated he didn't hear until after the game when he was either on the bus or when they got off of it (bus) that ALYSSA MCBRIDE was actually struck by a pitch. He heard the information from BEN HAYDEN. KRUS stated he couldn't recall if he was either told about it via text message or verbally by HAYDEN. KRUS stated he was concerned that this conversation would become an issue between he and the coaching staff. Goranson had been at the last game of the season to watch his daughter, Dani Goranson, play. Goranson stated he is a softball coach at a junior college in lllinois. Goranson does watch the batting practice prior to the games and did witness McBride get hit during batting practice prior to MSU's last game. Goranson was asked where the pitch that hit McBride was thrown and he stated it was thrown at her face. Goranson was also asked if he saw anything unusual with the pitch other than it being thrown at her face and he stated he didn't see anything with the pitch but the coaches lack of reaction surprised him. Goranson expected more of a reaction or apology after the pitch from Coach Joseph or Bograkos. Joseph was standing near Goranson and said " Hey, you ok." but he did not hear Bograkos say anything. Goranson was asked with his experience as a coach at the college level how common is it to hit players during batting practice. He stated that it does happen but it is rare. Goranson has watched Bograkos pitch in the past and he stated that she normally throws 58 mph to 61 mph during batting practices and pitches from in front of the mound. Goranson said that he knows the speed of the pitches because he always has a radar gun with him and has clocked her pitches in the past. Goranson did have the radar gun with him on the day McBride was struck but was not using it on that pitch. Goranson said he was aware of the controversy about the pitch that hit McBride. He stated that he hoped a coach would not throw at a players head since it could pennanently injure that player. Goranson could not tell from watching the pitch ifBograkos threw at McBride on purpose. I explained to him that I would have to contact McBRIDE directly to document the incident. I spoke to ~cBRIDE on 4/30/15 at 1:15 PM. This incident investigation concerns two separate pitches that struck McBRIDE during ~chigan State University batting practice on 4/29/15 and 5/3/15. McBRIDE is a current student at Michigan State University and a full scholarship athlete. She has been on the MSU softball team for the last four years and completed her last and final game of the season on Sunday, 5/3/15. The interview on 4/30/15 was recorded-a copy of the recording will be attached to this case file. McBRIDE told me that she was interviewed by a student reporter following a game they played against Notre Dame on Tuesday 4/28/15. She advised the interview centered around MSU softball and her experience at the university. She stated at one point during the interview the reporter asked her if they could speak "off the record" and assured her that the information she gave would be confidential. When he agreed she explained to him that she wished she had attended another school because of the way the softball coaching staff treats the players and the losing culture within the program. On Wednesday 4/29/15 she was notified by head coach JACQUELINE JOSEPH via text that she needed to meet with her (JOSEPH) in her office. McBRIDE said she arrived at the office at approximately 12:15 PM when JOSEPH told her the comments that she made were detrimental to the softball program. (McBRIDE wasn't sure how JOSEPH was aware of the comments she made during the interview but believed their media liaison may have obtained information that went to the coach). McBRIDE told JOSEPH that she made the comments because of their poor performance and she didn't feel that the players were treated right. Next, JOSEPH asked her if she wanted to travel on this date to the game at Central Michigan University to which McBRIDE answered of course. McBRIDE said that she participated in a batting practice on CMU's softball facility just prior to their game. She went on to say she batted at approximately 3:30 PM (4/29115). She said the individuals present at this time were assistant coach JESSICA BOGRAKOS (pitching/batting practice) DANI GORANSON (player), CHRISTINA ZALEWSKI (player) and head coach JOSEPH who was watching. McBRIDE stated that she thought it was strange that JOSEPH was watching the batting practice as she rarely does so when they are participating in road games. McBRIDE told me when she began batting the first few pitches were high and then a strike was thrown and she didn't swing. She advised BOGRAKOS began yelling at her for not swinging. She stated the next pitch came in with a much greater velocity than any of the previous pitches and was thrown directly at her neck by BOGRAKOS. McBRIDE said she was able to jump out of the way and tum causing the ball to strike her in the right wrist area. She told me she believed the pitch was made to intentionally strike her and said in four years BOGRAKOS has never come close to hitting her in batting practice. She further stated as soon as she got hit by the pitch JOSEPH immediately left the batting practice. McBRIDE said it appeared as though she was waiting for her to get hit by a pitch prior to leaving. When asked McBRIDE said she was a regular starter but did not start on this particular date. I asked McBRIDE if she was wearing a cage mask when batting to which she responded no. After the game at CMU (4/29/15) McBRIDE texted team manager BENJAMIN HAYDEN and told him that BOGRAKOS hit her on purpose with the pitch. She stated HAYDEN texted her back and explained to her he knew that was going to happen as he sits next to the coaches on bus trips and heard head coach JOSEPH say she can't do anything to her because she could get in trouble for something called "coach retaliation" but then added to BOGRAKOS that she could do something to her. HAYDEN stated he had shared this conversation he overheard between the two coaches with the other team manager AUSTIN KRUS after the bus ride to CMU and prior to the CMU game starting (game began at 4:00 PM). On Sunday 5/3/15 at 6 PM McBRIDE notified me that BOGRAK.OS hit her with another pitch during batting practice prior to their final game on this date at MSU and sent me two photos of the injury. I contacted her Monday morning and she told me she was participating in batting practice prior to MSU's final game on Sunday (5/3/15) at 12:30 PM. She said BOGRAK.OS was throwing in.practice as she always does. When she (McBRIDE) came up to bat BOGRAKOS threw five or six pitches at a normal speed over the plate and then increased the velocity and threw the next pitch directly at her head. She stated she moved her head out of the way but was struck with the ball on her left upper wrist which caused significant bruising, swelling and pain. Prior to the pitch assistant coach JT GAS SOW told her to keep her hands high which struck her as odd as she doesn't recall any coach ever telling her to do that during batting practice at MSU. McBRIDE once again stated that she was positive BOGRAKOS was throwing at her on purpose because of the variation in speed, placement and the fact that prior to her comments to the student reporter she (BOGRAKOS) has never come anywhere near hitting her in four years while pitching batting practice. McBRIDE had explained to me that BOGRAK.OS was an elite pitcher that held several records at MSU and was an All-American pitcher in women's softball. On this date McBRIDE told me that both DANI GORANSON and CHRISTINE ZALEWSKI witnessed the pitch. She added that JT GAS SOW and GORANSON's parents also saw what had occurred. When asked McBRIDE does not believe any other player was struck by a pitch from BOGRAKOS during either batting practice on Wednesday 4/29/15 or Sunday 5/3/15. McBRIDE told me that she is not filing this police report for her as she is done with the program but said it is for the players that are still in the program and those that will follow. She said the coaches mentally abuse the players and many of them (players) suffer from depression from the environment that they are subjected to. She added she just doesn't want anyone to hurt themselves or get hurt by one of the coaches. She explained if BOGRAK.OS hit a player in the face at the speed she threw the pitches at her they could be seriously injured.
