The Supreme Court adopted a four pronged standard for the grant of a stay in Pa. Public Util. Com v. Process Gas Consumers Group, 467 A.2d 805 (Pa. 1983). The four prongs are: 1) the petitioner makes a strong showing that he is likely to prevail on the merits; 2) the petitioner has shown that without the requested relief, he will suffer irreparable injury; 3) the issuance of a stay will not substantially harm the other interested parties in the proceedings; the issuance of a stay will not adversely affect the public interest. - 10. Petitioner contends that based on the evidence and circumstances that he will prevail at the appeal since he relied on information provided by the Respondent prior to issuing the certification and reported the issue to the Respondent. 11'. Petitioner will suffer irreparable injury without the requested relief, as his'livelihood is operating an auto repair business, and he will suffer loss of income. It is believed, and therefore averred, the Petitioner would lose customers to other businesses that have a valid official emission Certificate of Appointment. 12. Since those options were there I ?gured that they were usable and new I see that they are not They say that every emission machine is different at the emissions program this is why they don't go into detail. Johnson I think ere-found the whole reasoning behind the issues, which was the end link in the DLC connector that we connect to the car. We had the longest cable that you colt?Magi, and I'm pretty sure that the end must have gotten ran over or something. We wound up topl?l?e long end and it was a little distorted at the end. So went back to using the short cable which we had on hand. The thing behind that is, I wish that they did not have that option on the machine. I do not think that gould be available. Like I said it will never happen again. We had a car that would work and then we would have a car that would not work by that I mean not I ?gured that the connector woutd have been damaged because it was not reading. We did check the fuses, the grounds and that?s why I ?gured it was danggei because the I checked when it Was not was ok. The deal with the machine, I?n'nk something should be changed so those options are not on that machine.? MITIGATING EVENTS. Between January 10, 2013 and January 31. 2013 Emissions Inspector Dennis L. Lahr opemsomed and passed eight (3) vehicles indicating that the DLC was damaged or inaccessible (See Attachment). NOTE: The above information is incorrect. Dennis Lahr 0m not inspect and pass (8) vehicles.) Inspector Lahr inspected and indicating the DLC was Damlageiper the attached list, and Inspector Robert Johnson Indus ted and passed (3)}ehicles indicating the DLC was Dt?naged and inhale chemotnecmm Inaccessible per the sense} list. 8136011 Authorityfinspector Robert Johnson Ii. DIE?gated to this hearings examiner that when he tested the vehicles that he chose (D) damaged DLC for they wete not communide he could tic?tgg readings for them. (See Attachment A-l) He stated that he did check power and grounds on them, eveiything was ck, and the check engine lights were not on the vehicles. He stated that at the'time he thought the vehicles had damaged DLC's Ed that was why the vehicles wete not communicating so he therefore chose damaged. When questioned by this - hearings examiner if he called the hot line or checked the when dicse vehicles were not communi?ating Johnson Jr. stated no he did not because he was too busy and he thought they were not communicating because the DLOs on the vehicles were damaged. He stated that when he saw that there was an option to choose _da_maged on the analyzer he thought it was OK to do so. Inspector Johnson (it. stated that when he tested the 2001 - I Lincoln and chose (1) inaccessible he thought it was ok to do so because there was radio equipment in the way of the DLC and again, he saw that there was an option for him to choose inaccessible on the analyzer, therefore it was OK. Inspector Johnson Jr. stated that after the audit on 2f184l13 by QAO [stitch who; he had another Vehicle that did not communicate he found another cable at his station that was in a package unused that he did not realize that he had. He stated that he has had no issues with his ESP analyzer communicating since he used the new cable. Inspector Dennis Lahr (>ch to this heah?ngs examiner that when he tested the vehicles that he chose (D) damaged for he did not realize that this was nct?an option because he when he tookhis certi?cation class they did not specify what to do if you come across a vehicle that has a damaged DLC. He stated that the vehicles were not communicating and the analyzer would not allow him to continue with no communications, therefore he thought that the DLC was damaged and given the option of choosing damaged he thought that it was ok to do so. Inspector Lahr stated that he checked with Inspector Johnson Jr. when the vehicles did not communicate, and Ir_tspector Johnson Jr. told him that it would be ok to choose that the DLC was damaged.
