No hearing on the allegations was afforded to York Lube Center prior to the issuance of the penalties. 5. In addition to failing to provide the requisite hearing, PennDOT?s Order failed to state how or in What manner the inspections were allegedly; improper. I 6. York Lube Center has been in operation for three years and has no prior offenses as an of?cial emission inspection station. 7. The station owner had no knowledge of the alleged improper inspections at the time they were alleged to have occurred.- 8. The said suspension of York Lube Center?s Certi?cate of Appointment is improper or unlawful for the following reasons: a. failed .to provide York Lube Center with requisite due process by failing to provide notice and hearing on the matter prior to issuing a penalty.
