Inc. 19 Teharna St, Ste. 4 San Francisco CA 94105 NOTICE TO CEASE AND DESIST This letter places you on notice to cease and desist immediately all advertisements and operations as a for hire passenger carrier without a vaiid authority in force with the California Public Utilities Commission (Commission). Continued violations of the law may result in criminal prosecutions. Pursuant to Public Utilities Code sections 1031, 1037, 2108, and 21 10, any carrier that operates prior to issuance of their authority is guilty of a misdemeanor which is punishable by a ?ne of up to $5,000 or by imprisonment in the county jail for up to one year, or both. Each day of continued violations is a separate and distinct offense. Leap Transit, Inc. (Leap) must ?rst meet multiple requirements to receive a permit to operate. Specifically, Leap failed to ?le with the Commission: a Public Liability a: Property Damage insurance (Pub. Util. Code ?1040). - Evidence of workers? compensation insurance (Pub. Util. Code 460]. and 1043) I Evidence of compliance with the controlled substances and alcohol testing requirements (Pub. Util. Code 1032.1. 0 Tariffs (Pub. Util. Code 486 et sec.) 0 Letter of acceptance. Leap also failed to comply with additional safety requirements prior to operation. A search of the DMV Employer Pull Notice database faiied to show any record of Leap em'ollment in the Employer Pull Notice program as required by General Order 158 and California Vehicle Code ?1803. 1. Further, Leap failed to request the required bus and terminal inspections from the California Highway Patrol. Failure to immediately cease all operations until all licensing requirements are met will result in the Commission initiating enforcement actions to ensure compliance with the applicable laws.
