The Sealing Order pronounced in this matter on Thursday, the 12th day of March 2015, is set aside and the ?le is unsealed. Pursuant to section 30 of the Health Professions Act, RSBC 1996, 183: the College shall return to the respondents the items listed in Schedule to this Order; and the College is at liberty to dispose of or destroy those items listed in Schedule to this Order and may, if it determines that any item or items in Schedule are of use in the practice of dentistry, donate said item or items to a not-for?pro?t dental clinic in British Columbia, chosen at the College?s discretion. The respondent Valentyn Uvarov shall forfeit to the College the sterilization unit to Which reference is made in paragraphs 39 to 42 the af?davit #2 of Dr Alexander Penner filed in these proceedings, and the College is at liberty to donate said sterilization unit to a not-for-pro?t dental clinic in British Columbia, chosen at the College?s discretion. The respondent Valentyn Uvarov is hereby permanently enjoined and restrained from: using any titles reserved exclusively to registrants of the College: to describe his work; (ii) in association with or as part of another title describing his work; or in association with a description of his work; using any name, title, description or abbreviation of a name or title, or an equivalent of a name or title in another language, in any manner that expresses that he is a registrant of or associated with the College; providing any service that may only be provided by a registrant of the College; so long as he remains a person who is not a registrant of the College. The respondent Valentyn Uvarov is further permanently enjoined and restrained from recovering any fee or remuneration in any court in respect of the provision of a service that may only be provided by a registrant of the College unless, at the time he provided the service, he was a registrant of the College. 6. The reSpondent Valentyn Uvarov shall pay the College?s costs of this proceeding as party and party costs, ?xed in the amount of $10,000. 7. The petition is otherwise dismissed against the respondent Lyudmyla Uvarova on a no- costs basis.
