OFFICE OF THE MAYOR CITY OF HAMILTON April 27, 2015 Bert Clark President and Chief Executive Officer Infrastructure Ontario 2000 - 1 Dundas Street West Toronto ON M5G 2L5 Re: Substantial Completion of the Hamilton Stadium I am writing to express our grave concern that Ontario Sports Solutions (ONSS) has still not achieved Substantial Completion of the Hamilton Stadium and the unconscionable schedule that has been expressed that ONSS will achieve Substantial Completion by mid-May 2015. In a telephone conference call on April 23rd, ONSS stated that they would not be able to achieve Substantial Completion without carve-outs until the end of June. This position was reiterated at today's Pan Am Sub-committee meeting in the City of Hamilton's Council Chambers by David Kirkland of Kenaidan Construction, namely that certain key elements of the Hamilton Stadium will not have arrived onsite and be installed until the end of June. The Sponsors of the Hamilton Stadium, the City of Hamilton and Toronto 2015, have not agreed to any carve outs to the definition of Substantial Completion, as that term is defined in the Project Agreement between Infrastructure Ontario and ONSS. There is a growing misconception that Substantial Completion will be th completed by May 8 , which, given the schedules and comments to date, is unrealistic. The continued public communication of the May 8th Substantial Completion date creates false expectations, which is detrimental to the City, and others who may rely on such a date on planning events. A late-June date for Substantial Completion of the Hamilton Stadium places the City of Hamilton's events for May are in jeopardy. In fact, the City's ability to host the Pan Am Games soccer matches at the new Stadium also is in jeopardy. As you can appreciate, after ONSS delivers a Substantially Completed Stadium, the Sponsors need to complete additional construction work and training in advance of any events taking place in the Hamilton Stadium. Given that the original date for Substantial Completion was scheduled for June 30, 2014, and that ONSS has continuously missed their predicted dates for Substantial Completion in the past, we need a firm date on when we will receive Substantial Completion of the Hamilton Stadium so that we can govern our staff and plan with our stakeholders accordingly.
