Buncombe  County  Board  of  Commissioners  Opened  Minutes  from  Closed  Sessions  in  2014       January  7     Vice  Chair  Frost  moved  to  go  into  closed  session  pursuant  to  NCGS  143-­‐318.11a(5)  to  consider   possible  property  acquisitions  and  (6)  for  a  personnel  matter.  Commissioner  King  seconded  and   the  motion  passed  7-­‐0.     CLOSED  SESSION     Discussion  was  held  regarding  two  property  acquisitions  in  relation  to  county  school  facilities.   No  action  was  taken.     Discussion  was  held  with  the  County  Attorney  regarding  a  personnel  issue.  No  action  was  taken.       Commissioner  Jones  moved  to  return  to  open  session.  Commissioner  Fryar  seconded  and  the   motion  passed  7-­‐0.     Vice  Chair  Frost  moved  to  continue  the  meeting  to  5:30  p.m.  on  January  14.  Commissioner  King   seconded  and  the  motion  passed  7-­‐0.     February  18     Vice  Chair  Frost  moved  to  go  into  closed  session  pursuant  to  NCGS  143.318.11(4)  to  consider  a   possible  economic  development  incentive.  Commissioner  Belcher  seconded  and  the  motion   passed  7-­‐0.     CLOSED  SESSION     Discussion  was  held  regarding  a  possible  economic  development  incentive  for  an  existing   company.  The  Board  agreed  by  consensus  to  contact  the  Tourism  Development  Authority   regarding  funding  for  this  incentive.  No  action  was  taken.     Vice  Chair  Frost  moved  to  return  to  open  session.  Commissioner  Fryar  seconded  and  the   motion  passed  7-­‐0.     Commissioner  King  moved  to  adjourn  the  meeting.  Commissioner  Belcher  seconded  and  the   motion  passed  7-­‐0     March  4     Vice  Chair  Frost  moved  to  go  into  closed  session  pursuant  to  NCGS  143.318.11a(3)  to  consider  a   legal  issue.  Commissioner  Belcher  seconded  and  the  motion  passed  7-­‐0.     CLOSED  SESSION     The  Board  heard  a  report  from  Curt  Euler  regarding  the  Wilcoxson  vs.  Buncombe  County   lawsuit.  No  action  was  taken.     Vice  Chair  Frost  moved  to  return  to  open  session.  Commissioner  Fryar  seconded  and  the   motion  passed  7-­‐0.     May  13     Commissioner  Jones  moved  to  go  into  closed  session  pursuant  to  NCGS  143-­‐318.11a(4)  to   consider  a  possible  economic  development  incentive.  Commissioner  Belcher  seconded  and  the   motion  passed  7-­‐0.     CLOSED  SESSION     The  County  Manager  presented  a  possible  economic  development  incentive  for  a  company   considering  location  in  Buncombe  County  and  bringing  200-­‐300  jobs  and  making  a  $120  to  170   million  investments.  No  action  was  taken.     Vice  Chair  Frost  moved  to  return  to  open  session.  Commissioner  Fryar  seconded  and  the   motion  passed  7-­‐0.     June  17     Commissioner  Belcher  moved  to  go  into  closed  session  pursuant  to  NCGS  143-­‐318.11a(4)  to   consider  a  legal  matter  and  (4)  possible  economic  development  incentives.  Chairman  Gantt   seconded  and  the  motion  passed  7-­‐0.     CLOSED  SESSION     Discussion  was  held  regarding  a  potential  economic  development  incentive  for  an  existing   company  with  a  $3.8  million  investment.  The  Board  agreed  by  consensus  to  offer  an  incentive.     Discussion  was  held  regarding  incentives  for  one  new  business  with  a  potential  investment  of   $1.9  million,  bringing  65  jobs  and  the  expansion  of  one  existing  business  making  a  $5  million   investment  and  bringing  82  jobs.  The  Board  gave  consensus  to  pursue  both  businesses  with   incentives.     The  County  Attorney  updated  the  Board  on  a  legal  matter  involving  online  travel  companies   and  a  lawsuit  filed  a  few  years  ago  regarding  occupancy  tax.  The  Board  gave  the  attorney   consensus  to  pursue  a  settlement  of  this  matter.     Vice  Chair  Frost  moved  to  return  to  open  session.  Commissioner  Belcher  seconded  and  the   motion  passed  7-­‐0.     July  8     Commissioner  Jones  moved  to  go  into  closed  session  pursuant  to  NCGS  143-­‐318-­‐11a(4)  to   consider  several  legal  matters.  Commissioner  Fryar  seconded  and  the  motion  passed  7-­‐0.     CLOSED  SESSION     Discussion  was  held  regarding  a  workers  compensation  claim  involving  a  former  detention   center  officer.  The  Board  agreed  by  consensus  to  authorize  settlement  of  the  claim.     Mike  Frue,  Senior  Staff  Attorney,  gave  the  Board  an  update  on  the  Wilcoxson  lawsuit  and  the   Melanie  Petruillo  matter.  No  action  was  taken.     Mr.  Frue  updated  the  Board  on  the  running  of  the  CTS  waterline  and  the  Board  gave  consensus   to  proceed  with  running  of  the  line.     Commissioner  Jones  moved  to  return  to  open  session.  Commissioner  Belcher  seconded  and  the   motion  passed  7-­‐0.     August  5     Vice  Chair  Frost  moved  to  go  into  closed  session  pursuant  to  NCGS  143-­‐318-­‐11a  (4)  to  consider   several  economic  development  incentives;  (3)  legal  matters  (6)  for  a  personnel  matter.   Commissioner  King  seconded  and  the  motion  passed  7-­‐0.     CLOSED  SESSION     The  Board  discussed  a  possible  economic  development  incentive  for  a  new  company  bringing   more  than  300  jobs.  The  Board  gave  consensus  for  the  Manager  and  staff  to  proceed  with   negotiations.     The  Board  heard  a  personnel  issue  regarding  a  contract  employee.  No  action  was  taken.     The  Board  discussed  a  legal  matter  involving  risk  management  and  the  possibility  of  filing  of   claims.  No  action  was  taken.     Vice  Chair  Frost  moved  to  return  to  open  session.  Commissioner  Belcher  seconded  and  the   motion  passed  7-­‐0.     August  19     Commissioner  Belcher  moved  to  go  into  closed  session  pursuant  to  NCGS  143-­‐318-­‐11a  (4)  to   consider  several  economic  development  incentives.  Vice  Chair  Frost  seconded  and  the  motion   passed  7-­‐0.     CLOSED  SESSION     Jon  Creighton,  Assistant  County  Manager,  told  the  Board  about  a  possible  economic   development  incentive  that  would  bring  150  jobs  and  make  a  $20  million  investment.  The   Board  agreed  by  consensus  to  offer  an  incentive.     Commissioner  King  moved  to  return  to  open  session.  Commissioner  Fryar  seconded  and  the   motion  passed  7-­‐0.     September  16     Commissioner  Belcher  moved  to  go  into  closed  session  pursuant  to  NCGS  143-­‐318.11a  (4)  (6)  to   consider  an  economic  development  incentive  and  a  personnel  issue.  Commissioner  Fryar   seconded  and  the  motion  passed  7-­‐0.     CLOSED  SESSION   The  County  Manager  reported  on  the  status  of  a  possible  economic  development  incentive.  No   action  was  taken.     Jon  Creighton,  Assistant  County  Manager,  reported  on  a  possible  incentive  for  an  existing   industry  making  a  $175  to  $190  million  investment  and  bringing  400  jobs.  The  Board  gave   consensus  to  offer  the  appropriate  incentive.     Mandy  Stone,  Assistant  County  Manager  reported  on  the  status  of  an  employee.  No  action  was   taken.     Vice  Chair  Frost  moved  to  go  into  open  session.  Commissioner  Jones  seconded  and  the  motion   passed  7-­‐0.     November  18     Vice  Chair  Frost  moved  to  go  into  closed  session  to  consider  three  economic  development   matters  under  GS  143-­‐318.11(a)4.  There  would  be  no  action  taken.  Commissioner  Fryar   seconded  and  the  motion  passed  7-­‐0.     CLOSED  SESSION     The  Board  considered  a  $24,341  economic  development  incentive  for  an  existing  business  that   would  be  adding  37  jobs  at  an  average  wage  of  $37,500.  The  Board  gave  consensus  for  the   incentive.     The  Board  considered  an  incentive  for  an  existing  company  that  would  add  70  jobs  paying  an   average  wage  of  $35,000  as  part  of  a  $5.9  million  expansion.  The  Board  gave  consensus  for  the   incentive.     The  Board  rejected  an  incentive  request  for  an  existing  employer  that  would  be  making  a  $6.7   million  expansion  but  adding  no  jobs.   Commissioner  Belcher  moved  to  return  to  open  session.  Commissioner  Newman  seconded  and   the  motion  passed  7-­‐0.     December  1     Commissioner  Frost  moved  to  go  into  closed  session  to  consider  an  economic  development   matter  under  GS  143-­‐318.11(a)4.  There  would  be  no  action  taken.  Vice  Chair  Belcher  seconded   and  the  motion  passed  7-­‐0.     CLOSED  SESSION   Jon  Creighton,  Assistant  County  Manager,  updated  the  Board  on  a  possible  company  relocation   to  the  County  and  an  economic  development  incentive  for  the  company  that  would  bring  169   jobs  paying  an  average  wage  of  $39,000.  No  final  decision  had  been  made  and  the  Board  gave   consensus  approval  to  continue  to  negotiate  for  their  relocation.     Vice  Chair  Belcher  moved  to  return  to  open  session.  Commissioner  Fryar  seconded  and  the   motion  passed  7-­‐0.     Commissioner  Frost  moved  to  adjourn  the  meeting.  Commissioner  Fryar  seconded  and  the   motion  passed  7-­‐0.     The  meeting  was  adjourned  at
