Graham  County  Open  Minutes  from  Closed  Session  July  15,  2013  –  February  17,  2014       August  26,  2013     Attorney  Cody  stated  that  she  had  filed  the  Danya  Vanhook  lawsuit  in  court  today.     September  16,  2013     The  board  discussed  entering  into  a  contract  with  Terminix  to  take  care  of  the  courthouse   infestation.  The  concern  could  cause  a  potential  health  risk  for  our  employees.  The  cost  of  the   contract  is  $7983.00.       The  board  discussed  the  Danya  Vanhook  lawsuit  and  decided  to  hold  on  this  decision  until   Attorney  Cody  attended  the  next  meeting.  Attorney  Cody  and  Commissioner  Orr  were  out  due   to  the  death  of  Commissioner  Orr’s  beloved  sister,  Martha  Menard.     October  21,  2013     The  attorney  discussed  the  Danya  Vanhook  lawsuit  and  wanted  the  board  to  offer  a  settlement   to  her.       November  18,  2013     The  board  discussed  the  Town  of  Robbinsville’s  sewer  contract  and  agreed  that  they  would   need  to  have  an  agreement  that  no  hazardous  waste  would  be  put  into  the  county’s  dumpster.   The  board  all  agreed  not  to  charge  for  the  pickup  with  the  agreement.       Manager  Cable  stated  that  the  board  had  been  asked  to  support  a  diesel  mechanic  class  for  Tri-­‐ County.  The  board  was  okay  with  this  suggestion.    The  board  discussed  Tri-­‐County  closing  their   main  Graham  County  office  half  day  and  wanted  to  discuss  this  with  Dean  Donna  Tipton-­‐ Rogers.  The  sheriff’s  department  had  a  class  and  was  moved  three  times  and  Commissioner   Williams  had  concerns  with  this.  The  board  agreed  that  Commissioner  Williams  could  speak   with  Ms.  Tipton-­‐Rogers  about  any  concerns.     The  board  discussed  taking  applications  for  the  maintenance  position  and  wants  this  position   advertised.  The  board  also  wanted  Manager  Cable,  Clerk  Crisp  and  Rebecca  Garland  to  review   the  applications  and  bring  the  recommendations  to  the  board  since  they  are  the  ones  who  will   be  working  with  the  people  who  are  hired.  The  board  wanted  someone  hired  temporarily  until   advertisement  is  done  and  then  the  board  would  hire  a  permanent  position.  Clerk  Crisp  stated   that  she  would  get  the  notice  of  advertisement  into  the  paper  and  run  this  for  two  weeks.       Attorney  Donna  Cody  discussed  the  Danya  Vanhook  lawsuit  and  asks  the  board  what  they  want   to  do.  The  board  wanted  to  know  exactly  what  the  charges  were  for  and  offer  her  a  settlement.   The  attorney  stated  that  Ms.  Vanhook  did  a  good  job  while  she  was  at  DSS  and  she  did  the  work   while  she  was  there.  The  board  wanted  the  charges  listed  in  detail  and  a  total  figure  to  present   to  the  board.     Attorney  Donna  Cody  discussed  the  lawsuit  that  Sheriff  Mickey  Anderson  got  filed  on  him  on   Friday,  November  15,  2013.       December  16,  2013     The  board  discussed  the  Danya  Vanhook  lawsuit.  The  board  asks  Attorney  Cody  to  seek  a   settlement.     The  board  discussed  the  back  taxes  and  the  foreclosure  process  that  the  Tax  Collector  is   pursuing.  Clerk  Crisp  stated  that  some  taxpayers  had  requested  to  speak  with  the  board  in   closed  but  Clerk  Crisp  stated  that  this  is  not  a  closed  issue.         The  board  tabled  the  hiring  of  a  Custodian.     The  board  tabled  hiring  of  a  Maintenance  Director.     The  board  spoke  with  Claudie  Burchfield,  DSS  Director  on  safety  concerns  for  her  employees.   Ms.  Burchfield  requested  that  new  and  stronger  locks  be  put  on  the  doors  and  a  safety  check  of   the  building  is  needed  after  each  rental.     The  board  hired  Charlie  Smith  as  a  full  time  paramedic  due  to  Jeff  Ennis  retirement  and  hired   Bob  Keber  as  the  permanent  part  time  EMT  and  hired  Barry  Adams  as  a  third  call  driver  /  EMT   backup.       January  13,  2014     The  board  approved  a  pay  raise  for  Deputy  Andrew  Sampson  from  $10.50  to  $12.00  per  hour   due  his  receiving  BLET  Certification.       January  24,  2014     The  board  hired  Gavin  Colvard  as  the  full  time  Maintenance  Director.       The  board  hired  Nancy  Blevins  as  the  part  time  custodian.     The  board  discussed  the  Dillard  lawsuit  against  Sheriff  Anderson  and  wanted  a  $2500.00   settlement  offered  to  him.     The  board  discussed  hiring  Mack  Tallant  to  handle  the  closings  on  the  Cody  properties  that  the   county  is  trying  to  purchase  due  to  a  conflict  of  interest  on  our  county  attorney’s  part.     February  17,  2014     The  board  hired  Chris  Adams  as  the  full  time  dispatcher.  Misty  Hembree,  911  Director  stated   that  she  would  still  seek  a  part  time  worker.     The  board  discussed  hiring  someone  to  assist  with  the  finance  office  /  discussed  hiring  a  full  time  dispatcher.  Clerk  Crisp  stated  that  Misty  Hembree,   Director  had  recommended  Chris  Adams  for  the  full  time  dispatcher  and  would  like  to  request  a   hold  on  the  part-­‐time  hire  until  she  could  interview  some  more  candidates.     March  17,  2014     The  board  discussed  the  Adams  vs.  Hyatt  law  suit  and  stated  that  the  case  would  go  to   mediation.  Attorney  Cody  advised  the  board  that  this  settlement  will  not  be  an  admission  of   guilt  but  would  be  a  nuance  settlement.     The  board  discussed  the  Dillard  vs.  Sheriff  Anderson  law  suit  and  approved  an  offer  to  settle  of   $2500.00.     Clerk  Crisp  stated  that  Wanda  Hill,  Senior  Center  Director  had  received  a  call  from  Betty  Seay   from  the  State  of  Franklin  and  they  have  a  worker  that  she  can  use  to  help  with  the  cleaning  of   their  new  building.  Ms.  Hill  just  wanted  to  ask  permission  from  the  board  before  she  agreed  to   the  extra  help.     The  board  discussed  the  cost  of  doing  the  Town  of  Santeetlah’s  taxes.  Ms.  Garland  suggested   50%  of  the  five  year  back  taxes;  a  10%  going  forward  on  the  back  taxes  once  those  were   collected;  and  a  5%  to  7%  to  collect  the  current  taxes.  Ms.  Garland  stated  that  she  would  rather   train  their  personnel  but  that  the  county  could  collect  for  them.  Commissioner  Williams  asks   permission  to  speak  with  the  board  on  the  amount  to  charge.       March  25,  2014     Ms.  Becky  Garland  stated  that  she  had  a  contract  from  Frontier  for  911  Communications  in  the   amount  of  $33,858.58.  Ms.  Garland  stated  that  this  is  a  three  year  contract  and  it  is  paid   through  911  funds  and  is  a  recurring  expense  with  Frontier.  Ms.  Garland  stated  that  our  county   only  has  access  to  Frontier  services  which  makes  them  have  the  monopoly.     April  28,  2014     The  board  discussed  granting  a  road  easement  to  Jason  and  Lucas  Hooper  at  the  Ford  Street   Property.  Commissioner  Eller  stated  that  the  men  are  setting  up  a  produce  market  behind  the   Eller’s  Gas  Station  and  they  need  access  to  this  area.  Commissioner  Eller  stated  that  the  road  is   on  the  old  railroad  grade  and  this  belongs  to  Graham  County.  Attorney  Cody  stated  that  the   board  could  not  sell  the  property  but  they  could  grant  an  easement  across  the  property  with   the  understanding  that  it  is  to  be  used  for  public  purpose.  Commissioner  Eller  also  stated  that   the  Hooper’s  are  aware  they  will  have  to  fix  the  sidewalks  back  after  the  road  is  installed.   Manager  Cable  stated  that  EDC  Director  Andy  Cable  was  also  working  with  them  on  a  business   plan.  The  board  was  agreeable  to  this  easement  and  all  believe  that  we  need  to  help  establish   more  business  interest  in  the  county.     May  19,  2014     The  board  discussed  the  Senior  Center  position  for  a  full  and  part-­‐time  cook  to  take  care  of  the   senior  meals  and  the  jail  meals.  The  board  will  look  at  applications  at  the  next  meeting  for  these   positions.       May  30,  2014     The  board  discussed  the  Town  of  Santeetlah’s  tax  collections  contract  and  the  finance  officer   stated  that  they  cannot  give  payouts  twice  a  month,  it  would  only  be  once  and  the  response   time  may  not  be  within  10  days.  Clerk  Crisps  stated  that  our  policy  allows  for  30  days.  The   board  wanted  the  language  changed  to  once  a  month  for  payout  and  can  be  up  to  30  days  for   payment.  The  board  wanted  to  know  if  the  Town  was  agreeable  to  the  change.       June  16,  2014     Clerk  Crisp  stated  that  the  State  of  Franklin  had  hired  Nettie  Jenkins  and  she  will  cook  and   deliver  the  evening  jail  meal.  This  program  will  last  for  two  years  at  no  cost  to  the  county.
