Basis of the Charge (set forth a clear and concise statement of the facts constituting the alleged unfair labor practices) On Monday, February 16, 2015, a Hermandad Mexicana rally centered around the recent hour decreases at American Apparel, took place. American Apparel employees attended and took ?yers from the event which organized on S. Central- Avenue off of work time and American Apparel property. Upon leaving the rally, with ?yers in hand, Silvia Hernandez saw a security guard harass and interrogate Ana Amador. Ms. Amador, who also had flyers in her hands, was interrogated about her affiliation with the rally. Sylvia, scared and intimidated by this sight, hid from View but saw the security guard tear the flyers out of Ana's hands and escort her through the parking lot to her car. This coercive questioning on the part of security guard about Ana's protected activities, which Silvia witnessed and experienced second hand, chills the rights provided to union af?liates by the NLRA sections 7 and 8 (1). Silvia currently fears for her future as an employee after witnessing what happened to Ms. Amador. 3.
