February 2015 ET LE Electronic Monitoring  • CSC will be implementing a three year national research pilot. The research will study: • the effectiveness and efficiency of EM as a supervision tool; • the impact of the utilization of EM on offender outcomes; and • EM’s possible effects on offenders, staff, stakeholders, community supervision and public safety. • CSC will have access to up to 300 devices. • After the pilot has run for the initial three years, CSC will complete a formal research report, with recommendations, and submit it to the office of the Minister of Public Safety and Emergency Preparedness. 2 Electronic Monitoring • The Corrections and Conditional Release Act provides the Correctional Service of Canada (CSC) the authority to demand that an offender wear an Electronic Monitoring (EM) device to monitor compliance with geographical special conditions. • Offenders can make representation on the length of time they are required to wear the device. • Any refusal to wear a monitoring device or tampering with the device will result in a reassessment of risk. *sections 57.1(1) , 57.1(2) and 96. (m.1) of the Corrections and Conditional Release Act 3 Electronic Monitoring • EM is a supervision tool that will be used at the discretion of the supervising Parole Officer; EM itself will not be imposed as a condition. • EM can monitor geographical special conditions: • Avoid Certain Places • Remain in Certain Places • Curfews • Non-Association between two offenders both wearing an EM device • A Parole Officer can refer an offender to EM if he/she has a geographical special condition imposed on their Temporary Absence, Work Release, Parole, Statutory Release or Longterm Supervision Order. 4 Electronic Monitoring • CSC will use EM on high risk offenders: • Reintegration Potential of Medium or Low; and/or • In the case of a sex offender having a score of 4 or above on the Static-99/Static-99R • Parole Officers can make referrals to EM at the pre-release case preparation or post-release. • Monitoring of offenders on EM will be completed by the National Monitoring Centre (NMC). 5 Electronic Monitoring • An offender participating in EM is expected to wear the EM device at all times and not to remove or tamper with the device or other EM components. • Any violation of a condition that EM is monitoring (such as entering an exclusion zone), removal, tampering or refusing to wear the EM device will result in a reassessment of risk as per CD 715-2 Post-Release Decision Making paragraphs 12-14. • The National Monitoring Centre will communicate all violations of conditions being monitored directly to the supervising Parole Officer. • The decision to suspend an offender rests with the Parole Officer/Parole Officer Supervisor during business hours and with the National Duty Officer after hours. 6 Electronic Monitoring • CSC will be using EM technology that combines both Global Positioning System (GPS) and Radio Frequency (RF) into one device. • GPS technology allows for the continuous monitoring of an individual out in the community (good for monitoring exclusion/inclusion zones). • RF technology monitors the presence or absence of a person within a specific space/location, it simply confirms whether or not the individual is at/in a location at a specific time (such as a curfew at a residence). 7 Electronic Monitoring • The benefit of having a “hybrid” device is that when the offender returns home, the system automatically reverts to RF, which not only saves the battery life, but also eliminates GPS “drift”, which can affect the accuracy of a GPS point.
