Ew AFFIDAVIT la THE STATE OF TEXAS COUNTY or DALLAS {fl BEFORE ME, the undersigned Notary Public on this day personally appeared MAGGIE STROTHER, who, being by me duly sworn on oath deposed as follows On or about December 28, 2013, CARLOS RAUL CORTEZ, my ex--boyfriend assaulted me and threatened to kill me. Carlos and I had gone out earlier in the evening for dinner and drinks. Carlos became agitated at the restaurant; however we finished our meals and returned to his home. Shortly after our return, I put my son to bed. While I was putting my son to bed, Carlos began watching television and drinking wine. Carlos also poured me a glass of wine. My son was unable to sleep because of an upset stomach and I began to go back and forth between the living room and bedroom to check on him. Carlos inquired about my son's condition, and I responded that both he and I had upset stomachs. Carlos instantly became angry and ranted that he was tired of me being sick and that there was always something wrong with me. I responded that my body had been through a lot and reminded him of recent health issues and a medical procedure I had undergone. This further angered Carlos and he continued cursing and yelling. Carlos then began hitting me under the chin. He lifted me off the couch by my hair with one hand and was choking me with the other. It became difficult for me to breath. As Carlos continued to pull me by hair and choke me I fell to the floor. Carlos then lifted me up by the hair and dragged me to the balcony. Carlos then lifted me up by my neck, and had my back leaning over the railing. Carlos continued choking and pulling my hair while he held me against the railing and threatened to kill me. He eventually let me go, and I began packing and went to get my son. Carlos followed me into the bedroom and flipped on the light. As my son and I were leaving Carlos' home, Carlos began verbally insulting the back of my head and on the forehead, causing pain. I began screaming for help after getting out in the hallway, hoping someone would hear me. Carlos continued to throw my personal belongings out in the hallway and yell at me. A couple came out of their unit and assisted me and my son. I gathered my belongings and went downstairs to my car. Once I was at my car, I realized that I did not have my son's asthma medication and called Carlos several times asking for it. After he refused to give it to me, I told Carlos that I was calling the police. Before the police arrived, Carlos approached me in the lobby and handed me the medicine bag. When the Dallas Police officer first arrived, I only informed him ofthe problem with Carlos refusing to give me the medication bag. After speaking with the officer, I walked over to an area where I felt Carlos would not see me and motioned for the officer to come over where I was. I then disclosed the details ofthe physical assault, and showed the injuries on my neck. Dallas Police officers arrested Carlos for Assault/Family Violence Strangulation (F13--63761). I was also issued an Emergency Protective Order for 61 days. On or about the middle of March 2013, Carlos assaulted me. I was spending the night with Carlos that evening. I was in bed sleeping when Carlos pulled me by my hair and arm offthe bed causing my back to hit the bed frame. Carlos continued to drag me by the hair across the tile floor to the front door. As he pulled me across the room, he repeatedly hit my head against the floor and caused clumps of my hair to come out of my head, causing pain. When Carlos got me to the front door, he opened it and began grabbing my belongings and tossing them outside. I eventually gathered my belongings and Carlos allowed me back inside of his home. A few days later, I had lunch with a friend who noticed the bruises on my arm. I began crying and told my friend that Carlos had been violent against me. We went to a dressing room in a store, and took pictures of my injuries. After a few days, I went to the Allen Police Department to report the incident. Since the incident took place in Dallas, Allen Police Department directed me to the Dallas Police Department. In the past, I was fearful to contact the police in Dallas because of the position Carlos held in Dallas and because of his political connections. Although I spoke with the Dallas Police Department, I decided not to follow up with the police report that I made and I reconciled with Carlos. Carlos and I dated off and on for 13 months. Throughout our relationship, Carlos was physically abusive towards me. On several occasions, I have felt sexually violated by Carlos. Carlos was also extremely controlling and jealous. Carlos isolated me from my friends and family. Carlos would constantly go through my cell phone to see who I was talking to, and accuse me of cheating on him with other men. On one occasion, Carlos read a text message on my phone and became so agitated with me that he pushed me causing me to fall on the floor. Carlos would contact my friends on my social networking page and through text messages. During a period when Carlos and were separated, Carlos frequently showed up unannounced and caused disruptive scenes at public places where I was. I have been reluctant and fearful of reporting the abuse due to Carlos' political status as a judge. Carlos repeatedly warned me that disclosing his abuse and threats would not be heard because of his status and position. I am embarrassed that I allowed the abuse to continue and fearful that my life is in danger now that I have reported his abuse. I have wanted to believe that Carlos would change, but even after he told me that he was seeing a therapist, his violence has escalated. I now realize after the most recent incident Carlos could have killed me and I refuse to live in fearfor my life. I am begging the court for the protection I need in order to remain safe. I am the Applicant in the attached Application for Protective Order. I have read the attached Affidavit; and I have personal knowledge of the facts contained in it, and they are true and correct.
